Case Number 2004-007346 RODNEY DEAN HINDERLITER, Respondent, / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, (“Petitioner”), files this Administrative Complaint before the Electrical Contractors’ Licensing Board, against RODNEY DEAN HINDERLITER (“Respondent”), and says: 1. Petitioner is the state agency charged with regulating the practice of electtical contracting pursuant to section 20.165, Florida Statutes, and chapters 455 and 489, Part IT, Florida Statutes. 2. Respondent is, and has been at all times material hereto, a licensed REGISTERED ELECTRICAL CONTRACTOR in the State of Florida, having been issued license number ER 14748. 3. Respondent's address of record is 100 Steven Street, Apt #11, Santa Rosa Beach, Florida 32459. 4, On Angust 1, 2002, the Electric Contractors’ Licensing Board filed Final Order number BPR 2002-02871 against the Respondent. Final Order BPR 2002-02871 was properly rendered by the Department of Business and Professional Regulation’s Agency Clerks Office on August 1, 2002, by certified mail to the Respondents address of record. | 6. Final Order BPR 2002-02871 required the Respondent to pay administrative fines and costs totaling $2576.83. 7. Respondent was requited to pay the Fines and Costs within 30 days of the filing of Final Order BPR 2002-02871. 3. Respondent’s final payment of the Fine and Costs totaling $2576.83 was due on or before September 1, 2002. . 9. To date, Respondent has failed to comply with Final Order BPR-2002-02871 by failing to pay the required amount of $2576.83. 10. Section 455.227 (1)(q), Florida Statutes, states that the following shall constitute grounds for which disciplinary actions may be taken, “[v]iolating any provision of this chapter, the applicable professional practice act, a mile of the department or the board, or a lawful order of the department or the board, or failing to comply with a lawfully issued subpoena of the department.” 11. Section 489.533(1)(a), Florida Statutes, states that the following shall constitute grounds for which disciplinary actions may be taken, "[flailure to comply with any provision of chapter 455.” 12. Based upon the foregoing, the Respondent has violated section 489.533(1)(a), Florida Statutes, by failing to comply with Final Order number BPR. 2002-02871, and is therefore subject to disciplinary action by the Board pursuant to sections 489.533(1)(a) and (2), Florida Statutes. Oct 12 2006 9:29 16/12/2866 69:22 B5e4146749 DEPR OGA PAGE 65/86 WHEREFORE, Petitioner respectfully requests the Electrical Contractors’ Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or ‘ registration, require correction, impose an administrative fine not to exceed $5,000 per violation, Tequire continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within chapters 455 and 489 Part II, Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to chapters 489 and 455, Florida Statutes, and/or the rules promulgated thereunder.
