CASE NO. 2005038196 ASHLEY LYNN SEIBERT, p L Respondent. lo ‘ | U K S ; ADMINISTRATIVE COMPLAINT The Florida Department of Business & Professional Regulation, Division of Real Estate ("Petitioner") files this Administrative Complaint against Ashley Lynn Seibert (“Respondent"), and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, including Section 20.165 and Chapters 120, 455 and 475 of the Florida Statutes, and the rules promulgated thereunder. 2. Respondent is currently a Florida state certified residential real estate appraiser having been issued license 5451 in accordance with Chapter 475 Part II of the Florida Statutes. 3. The last license the State issued to Respondent was as a state certified residential real estate appraiser at P. O. Box 07038, 6775 Overlook Drive, Ft. Myers, Florida 33919. . 4, On or about June 5, 2005, Ashely Lynn Seibert (Respondent) developed and FDBPR v. Ashley Lynn Seibert Case No. 2005038196 Administrative Complaint communicated an appraisal report (Report) for property commonly known as 2248 Ephraim Avenue, Ft. Myers, FL (Subject Property) and estimated its value as $250,000. A copy of the Report is attached hereto and incorporated herein as Administrative Complaint Exhibit 1. _ 5, At the time the Report was developed and communicated, Respondent was a Registered Trainee Appraiser. 6. Marc Anthony Sasso (Complainant) is a Certified Residential Real Estate Appraiser who supervised Respondent from January 28, 2005 to approximately July 6, 2005. A copy of Respondent’s licensure supervision by Complainant is attached hereto and incorporated herein as Administrative Complaint Composite Exhibit 2. 7. Respondent developed and communicated the Report on her own, without Complainant’s knowledge or supervision. Respondent affixed Complainant’s name and digital signature to the Report, and checked the certification box indicating Complainant personally inspected the Subject ‘Property. However, Complainant did not participate in the development and communication of the Report, and had no knowledge of the Report.. Respondent knew or should have known that Complainant did not inspect the Subject Property. 8. Respondent accepted the appraisal assignment and compensation for the Report directly from the appraisal client. 9. On-Respondent’s trainee experience log, Respondent failed to include the client’s name and address; the number of hours worked; they type of appraisal report developed; the type of property appraised; and the signature and license number of the supervisory appraiser. A copy of Respondent’s trainee appraisal experience log is attached hereto and incorporated herein as FDBPR v. Ashley Lynn Seibert Case No. 2005038196 Administrative Complaint Administrative Complaint Composite Exhibit 3. 10. Respondent started her own appraisal company, “Hot Appraisals LLC,” and registered the LLC with the Florida Department of State, Division of Corporations on or about March 1, 2005. Respondent founded and operated Hot Appraisals LLC while still a Registered Trainee Appraiser. | COUNT I Based upon the foregoing, Respondent is guilty of misrepresentation, in violation of Section 475.624(2), Florida Statutes. COUNT II Based upon the foregoing, Respondent is guilty of failing to perform appraisal services under the direct supervision of a licensed or certified appraiser who is designated as the primary or secondary supervisory appraiser, in violation of Section 475.6221(1), Florida Statutes and therefore, in violation of Section 475.624(4), Florida Statutes. COUNT II Based upon the foregoing, Respondent is guilty of receiving compensation for appraisal services from someone other than the primary supervisory appraiser, in violation of Section 475.6221(2), Florida Statutes and therefore, in violation of Section 475.624(4), Florida Statutes. COUNT IV Based upon the foregoing, Respondent is guilty of accepting appraisal assignments from someone other than his or her primary or secondary supervisory appraiser, in violation of the definition of Registered Trainee Appraiser, Section 475.611(1)(m), Florida Statutes and therefore, in violation of Section 475.624(4), Florida Statutes. Ashley Lyon Seibert Case No. 2005038196 Administrative Complaint COUNT V Based upon the foregoing, Respondent has violated a standard for the development or communication of a real estate appraisal, specifically the Conduct Section of the USPAP Ethics Rule: failure to perform appraisal in an ethical manner, or other provision of the Uniform Standards of Professional Appraisal Practice in violation of Section 475.624(14), Florida Statutes. COUNT VI Based upon the foregoing, Respondent has violated a standard for the development or communication of a real estate appraisal, specifically the definition of Signature in the Definition Section of the USPAP by obtaining and affixing the digital signature of another to an appraisal report, or other provision of the Uniform Standards of Professional Appraisal Practice, in violation of . Section 475.624(14), Florida Statutes. COUNT VIL Based upon the foregoing, Respondent is guilty of failing to include ail of the required information on her trainee appraisal experience log, in violation of Florida Admin. Code Rule 61J1- 4.010(6) and, therefore, in violation of Section 475.624(4), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Appraisal Board, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the FDBPR v. Ashley Lynn Seibert Case No. 2005038196 Administrative Complaint offense(s), include: revocation of the license, registration, or certificate; suspension of the license, registration or certificate for a period not to exceed ten (10) years; imposition of an administrative fine of up to $5,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant, or certificate holder to complete and pass additional appraisal education courses; publication, or any combination of the foregoing which may apply.
