STATE OF FLORIDA DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION ELECTRICAL CONTRACTORS’ LICENSING BOARD DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, Petitioner, Vv. Case Number 2005-052238 LEO HASSEN, d/b/a HASSEN INTERIORS, INC., Respondent, / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, (“Petitioner”), files this Administrative Complaint before the Electrical Contractors’ Licensing Board, against LEO HASSEN (“Respondent”), and says: 1. Petitioner is the state agency charged with regulating the practice of electrical contracting pursuant to section 20.165, Florida Statutes, and chapters 455 and 489, Part II, Florida Statutes, 2. Respondent’s address of record 601 75 Street, Apt. #4, Miami Beach, Florida 33141. 3. At no time material hereto did Respondent have a licensed qualifier who was certified, registered or otherwise licensed in the State of Florida to qualify the Respondent or his company to operate as an electrical contractor. 4, At no time material hereto was Respondent registered, certified or otherwise qualified to operate as an electrical contractor or an electrical contracting business in the State of 9B/EB Said YOO sddd Bp29P Tress ES:ST 9aae/ST/TT oo:9T 9002 ST Ao Florida. 5. On June 21, 2005, Respondent entered into a written contract with Mr, Jeff Beal, to build an addition to Beal’s residence, which was to include electrical work, located at 4542 Sheridan Avenue, Miami Beach, Florida 33140. 6. Respondent received $22,250.00 in remuneration for his services. 7. The contract called for the installation of a kitchen ceiling light; a fan light in the dining room; additional room for a laundry room with sufficient plumbing and electric to install clothes washer and dryer, and window AC unit; and install exterior electrical outlet on rear of the house. 8 Section 489.505(9), Florida Statutes, states that "Contracting" means, except where exempted in this part, engaging in business as a contractor or performing electrical or alarm work for compensation and includes, but is not limited to, performance of any of the acts found in subsections (2) and (12), which define the services which a contractor is allowed to perform. The attempted sale of contracting services and the negotiation or bid for a contract on these services algo constitutes contracting. If the services offered require licensure or agent qualification, the offering, negotiation for a bid, or attempted sale of these services requires the corresponding licensure. 9. Contracting to undertake electrical work requires a valid electrical contractor’s license. 10. Section 489.531(1)(a), Florida Statutes, states that the following shall constitute grounds for which disciplinary actions may be taken, "[p]ractice contracting unless the person is certified or registered.” 11, Based upon the foregoing, the Respondent has violated section 489.531(1)(a), 9a/Pa SSK YOO sddd Bp29P Tress ES:ST 9aae/GT/TT 0o:9T 900¢ OT AON Florida Statutes, by failing to have proper registration or certification, and is therefore subject to disciplinary action by the Board pursuant to sections 489.531(1)(a) and 489.533(2), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Electrical Contractors’ Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require correction, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within chapters 455 and 489 Part Il, Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to chapters 489 and 455, Florida Statutes, and/or the rules promulgated thereunder.
