Dudkiewicz, Licensee & COIC Elite Pest Management, JB139396 10067 Cara Street Spring Hill, Florida 34608 RE: ADMINISTRATIVE COMPLAINT AND SETTLEMENT AGREEMENT Administrative Complaint # A43507 BEPC Case # 06-239 INVESTIGATIVE RESULTS The Department of Agriculture and Consumer Services (“Department”) conducted an . investigation and found the following violation(s): During the period of May 20, 2005, through February 13, 2006, the Department has learned that Richard J. Dudkiewicz performed preconstruction subterranean termite treatments and issued no less than 178 subterranean termite contracts in the State of Florida even though he did not have a Pest Control Business License issued by the Bureau of Entomology & Pest Control. A Department inspector made numerous attempts to contact Mr. Dudkiewicz, including phone calls and a certified letter to his address of record, to arrange an interview to discuss a consumer complaint filed with the Department involving these treatments, but a meeting could never be arranged. The Department inspector was able to confirm and collect records from Westfield Homes who had used Mr. Dudkiewicz and his unlicensed company, Elite Pest Systems, for these preconstruction subterranean termite treatments. On February 13, 2006, Mr. Dudkiewicz was issued a new Pest Control Business License, number JB139396, to operate as Elite Pest Management. Count 1- Performing preconstruction subterranean termite treatments and issuing preconstruction subterranean termite contracts without a Pest Control Business License and permit to perform preventative termite treatment for new construction is a violation of Section(s) 482.071(1) and 482.0815, Florida Statutes. Dudkiewicz, Licensee & COIC Elite Pest Management, JB139396 4p, PY BEPC Case # 06-239 ih iy ¢; LAS, SY Page Two ; BS Oo UL MWA Dy ) O5' He SETTLEMENT At this time the Department is willing to settle this matter as follows: (a) An admission of violation of Section(s) 482.071(1) and 482.0815, Florida Statutes; and (b) Payment of an Administrative Fine in the form of a check or money order made payable to the “Department of Agriculture and Consumer Services” in the amount of THREE THOUSAND DOLLARS ($3,000) to resolve this matter; and (c) Your signature affixed on the attached Settlement Agreement; and (d) Receipt by the Department of the settlement documents within 21 days of your receipt of this letter. ‘ If this settlement is acceptable, please indicate your acceptance by signing the attached Setilement Agreement and returning the original of this letter along with all other documents required for settlement in the enclosed envelope within twenty-one (21) days of receipt of this letter. Acceptance of this settlement and the timely return to the Department of all settlement documents will conclude this matter subject to final approval by the Commissioner’s office. ADMINISTRATIVE HEARING AVAILABLE If you wish to contest the department’s findings, you have the right to request an administrative hearing to be conducted in accordance with Sections 120.569 and 120.57, Florida Statutes, to be represented by counsel or other qualified representative, to present evidence and argument, to call and cross-examine witnesses, and to have subpoena and subpoena duces tecum issued on your behalfif a hearing is requested. Your request for hearing must contain your name and address for purposes of service, a statement requesting either a hearing involving disputed issues of material fact or a hearing not involving disputed issues of material fact, and a reference to this administrative complaint. If you request a hearing the offer of settlement is withdrawn and you may receive a more severe penalty.
