Respondent was sertified by the Criminal Justice Standards and Training Commission on December 18, 1998 and was ‘issued Corrections Certification ‘Number 186961° and on November 8, 2005 and wag issued Law Enforcement Certification Number 252796 and on November 17, 2003 and was issued Instructor Certifiaate Number. 235454." 2. (a) On or about July 24, 2004, the Respondent, Eric D. Rodgers, did unlawfully attempt to commit a Sexual battery upon Amanda Feehley, a person twelva years of age or older,- without said person's consent, by attempting to engage in sexual intercourse, and in the Process thereof used physical force and violence not ‘Likely tO cause seriots personal injury. Rodgers, did unlawfully enter or remain in a certain dwelling. or structure, to-wit: Towne Place Suites, a hotel located at or in the vicinity of 1876 N.E. Capital Circle Apt # 309, the property of Towne Place Suites, as owner or custodian thereof, with the intent to commit an offense therein, to-wit: Sexual Battery. 3. The actions of the Respondent did violate the provisions of Section 794,011 and or 810.02 Florida Statutes or any lesser included offenses, Section 943.1395(6) and/or (7), Florida Statutes, and/or Rules 11B- 27.0041(4)a and/or 1iB-20.0012 (1) (£), Florida Administrative Code, in that Respondent has failéd to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Corrections officer, and/or Law Enforcement officer. and/or Instructor in the State Of Florida have good moral character and which gives rise to a disciplinary action against Respondent's certification. 4. This Administrative Complaint is issued pursuant to Sections 120.60, 943.12(3) ana 943.1395(6) and/or (7), Flerida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant te Sections 120.569 and 120.57, Florida Statutes, and Rules 11-27, 28-106, and 28-107, Florida Administrative Code.
