POWELL C.L NO. 06-4460-000 v. TEAMCARE INFUSION, Respondent. / FINAL ORDER THIS CAUSE is before me for issuance of a Final Order. In a letter dated December 19, 2006, Teamcare Infusion, Inc. (Respondent) was informed that the State of Florida, Agency for Health Care Administration (Agency) was seeking to recoup Medicaid overpayments in the amount of $67,737.60. Additionally, the Provider was notified that the Agency imposed a fine in the amount of $2,000.00 and required the submission of a corrective action plan in the form of acknowledge statement, pursuant to Rule 59G-9.070, Florida Administrative Code. Pursuant to Section 409.913(6), F.S., the letter was sent Certified Mail, return receipt requested, to Respondent at the address last shown on the provider enrollment file. Respondent signed for the letter on January 22, 2007. A Petition for a Formal Administrative Hearing was filed on February 8, 2007. On February 16, 2007, the Petition was forwarded to the Division of Administrative Hearings (“DOAH”) by the Agency and assigned to an Administrative Law Judge (“ALJ”). On June 1, 2007, the Respondent filed a Notice of Withdrawal of Petition for Forma! Hearing. On June 4, 2007, the ALJ issued an Order Closing File based on the Respondent’s Notice of Withdrawal of Petition for Formal Hearing. ORDER BASED on the forgoing, it is ORDERED and ADJUDGED that Respondent refund, forthwith, the sum of $67,737.60 plus a fine of $2,000.00 for a total of $69,737.60, together with statutory interest as set forth in §409.913(24)(b), Florida Statutes, and submit the corrective acknowledgement statement in the form of an acknowledgement statement.
