Vogel, III, filed a petition requesting an administrative ibaringon February 21, 2007. By this petition, Mr. Vogel sought to dispute the invalidation of his January scores on the Mathematics 6-12 exam. The Department referred the case to the Division of Administrative Hearings and requested the assignment of an administrative law judge. In a March 20, 2007, letter to Administrative Law Judge R. Bruce McKibben, Mr. Vogel requested a voluntary dismissal of his petition against the Department. Judge McKibben granted Mr. Vogel’s request in an “Order Closing File” dated March 23, 2007.
