PROFESSIONAL REGULATION, BOARD OF ARCHITECTURE AND INTERIOR DESIGN, - (07-3497 Petitioner, . vs. CASE NO.: 2007-006428. MICHAEL E. CRADDOCK, Respondent. / ADMINISTRATIVE COMPLAINT. Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board of Architecture and Interior Design against MICHAEL E. CRADDOCK, ("Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of architecture and interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481, Florida Statutes. 2. The Department of Business and Professional Regulation has jurisdiction over the unlicensed practice of architecture pursuant to Section 455.228(1), and Section 481.223(1)(a), Florida Statutes. 3. At all times material hereto, Respondent was not duly registered or certified to engage in the practice of architecture in the State of Florida pursuant to Chapter 481, Florida Statutes. 4. Respondent’s last known address is 401 NW 15" Street, Boca Raton, Florida 33432, . 5. Respondent was previously a licensed architect in the State of Florida, having been issued license number AR 11751. 6. -As of March 1,:2003, Respondent's license was placed in a delinquent status for failing to renew. | . 7. As of March 1, 2005, Respondent’s license was placed in a null and void status for failing to renew. . 8. On or about August 12, 2005;. Respondent entered into a contract with John Carrier to provide architectural services for a residential property located at 898 NE Boca Raton Road, Boca Raton, Florida. 9. The contract is titled Architect’s Proposal for Professional Services. 10. The contract contains Respondent's null and void architectural license number. 11. Inthe contract, the Respondent uses the title architect. 12. Respondent received $2,000.00 pursuant to the above contract and did not perform the services required. 13. Respondent is no longer a licensed architect in the State of Florida and therefore cannot use his null and void license number, use the title architect, or offer architectural services. COUNT I 14. Petitioner hereby realleges and incorporates paragraphs one a) through thirteen (13) as if fully set forth herein. 15. Section 481.223(1)(a), Florida Statutes, states that a person may not knowingly “practice architecture unless the person is an architect or a registered architect.” 16. Based-upon the foregoing, Respondent has violated Section 481.223(1)(a), Florida Statutes, by practicing architecture when he was not the holder of a valid license by offering to provide architectural services. COUNT IL 17. Petitioner hereby realleges and incorporates paragraphs one (1) through thirteen (13) as if fully set forth herein. . 18. Section 481.223(1)(c), Florida Statutes, states that a person may not knowingly “use the name or title ‘architect’ or ‘registered architect’ or words to that effect, when the. person is not then the holder of a valid license.” 19. Based upon the foregoing, the Respondent has violated Section 481.223(1)(c), Florida Statutes, by using the name or title “architect”, when he was not the holder of a valid license. COUNT It 20. Petitioner hereby realleges and incorporates paragraphs one (1) through thirteen (13) as if fully set forth herein. 21. Section 481.223(1)(f), Florida Statutes, prohibits a person from using or attempting to use an architect license that has been suspended, revoked, or placed on inactive or delinquent status. 22. Based upon the foregoing, the Respondent has violated Section 481.223(1)(f, Florida Statutes, by attempting to use his architect license while it was in a null and void status. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing an’ administrative fine not to exceed $5,000 per count, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other. relief that the Board is authorized to impose pursuant to Chapters 481 and 455, Florida Statutes, and/or the rules promulgated thereunder. y Signed this se" day of tay dee.
