CRIMINAL JUSTICE STANDARDS AND TRAINING COMMISSION, Petitioner, vs. : CASE NO. 24455 Bobby Smith, Respondent. / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Bobby Smith. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: . 1. Respondent was certified by the Criminal Justice Standards and Training Commission on May 12, 1988, and was issued Law Enforcement Certificate Number $2732 and on June 30, 1994, was issued Instructor Certificate Number 209909, 2. ° (a) On or about February 6, 2007, the Respondent, Bobby Smith, was adjudicated guilty of Driving Under the Influence before the Cireuit Court in and for the Tenth Judicial Cacuit, in and for Polk County, Florida, (b) On or about December 6, 2006, the Respondent, Bobby Smith, did un lawfully, while operating a vehicle upon a street or highway and having knowledge that he had been directed to stop such vehicle by a duly authorized police officer, willfully refuse ot fail to stop such vehicle in compliance with such directive, or, having stopped in knowing compliance with such directive, willfully flee in an attempt to elude such officer. 3. The actions of the Respondent did violate the provisions of Section 316.193; 316.1935 or any lesser included offenses, Section 943,1395(7), Florida Statutes, and Rules 11B-27.0011/4)(b); (a) and 11B-20.0012(2)(f), Florida Administrative Code, in that’ Respondent has failed to maintain the Aug 6 2007 13:56 ge/Ge/28e7 13:52 8584187691 FDLE O08 PAGE 85/86 qualifications established in Seetion 943.13(7), Florida Statutes, which require that a Law Enforcement and Instructor officer in the State of Florida have good moral character and which gives risé to a disciplinary action against Respondent's certification. 4. This Administrative Complaint is issued pursuant to Sections 120.60, 943 12(3), and 943,1395(7), Florida Statutes. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Chapters 118-20, 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Bobby Smith is guilty of violating Sections 943,1395(7), and 943.13(7), Florida Statutes, and Rules LIB-27.0011(4)¢b); (a) and 118-20.0012(2)(f), Florida Administrative Code. . NOW, THEREFORE, the Florida Criminal Justice Standards and Training Conimission hereby complains against Bobby Smith and alleges that an appropriate penalty, as provided in Section 943,1393(7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights ‘form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein. ; BY ORDER OF THE CRIMINAL JUSTICE STANDARDS AND TRAINING COMMISSION THIS 12th DAY OF June, 2007.
