(a) On or about May 3, 2004, the Respondent, John Bandorf, did unlawfully and intentionally commit an assault upon Scett David Ferenaz, by threatening by word er act te do violence to said person, coupled with an apparent ability to do so, and by doing an act which created a well-founded fear in said Scott David Ferenoz that said violence was imminent, by unlawfully and intentionally striking the 1996 4 door Jeep of Scott David Ferencz, causing damage with a’ deadly weapon, to-wit: a 1997 Ford van. Jan 16 200? 17:09 PAGE @5/@8 @1l/16/28e87 17:86 8584187691 FDLE O08 (6b) On or about May 3, 2004, the Respondent, John Bandorf, did unlawfully, knowingly, snd willfully resist, obstruct or oppose Holly Holly Hill Police Office Michael Coomans, in the lawful axecution of any legal duty, to wit? a traffic stop, by refusing to pull over | and/or roll down window and/or unlock doors. (c) On or about May 3, 2004, the Respondent, John Bandor£, did unlawfully and willfully flee or attempt to elude Michal Coomans, haw enforcement officer and others, in authorized law enforcement patrol vehicles of the Holly Hill Police Department, with Agency insignia and other | jurdisdietional markings prominently displayed on the vehicles, with siren and lights activated and during the course of the fleeing or attempted eluding did drive in a manner which demonstrated a wanton disregard for the safety of persons or property. 3. The actions of the Respondent did violate the provisions of Section 784.021 (1) (a) and/or 843.02 and/or 316.1935 (3) Florida Statutes or any lesser included offenses, Section 943,1395(6) and/or (7), Wlorida Statutes, and/or Rule 11B-27.0011(4)a,b, Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which wequire that a Correctional Officer in the State of Florida. hava good moral character, 4. "This Administrative Complaint is issued pursuant to Sectiona 120.60, and 943.1395 (6) and/or (7), ‘Florida Statutes.
