Department of Business and Professional Regulation, Division of Pari-Mutuel Wagering
(hereinafter Petitioner"), files this Administrative Complaint against Council L. Pickels
(hereinafter "Respondent"), and says:
1. Petitioner is the state agency charged with regulating the practice of pari-mutuel
wagering pursuant to Chapter 350, Florida Statutes,
2. At all times material hereto, Respondent held a pari-mutuel wagering
occupational license, number 324100-103 1, issued by the Division.
3. Rule 61D-6.009(2), Florida Administrative Code, provides:
Each racing animal permitholder shall employ a veterinarian (the track - or
permitholder veterinarian) who is Hcensed by and in good standing with the
Florida State Board of Veterinary Medicine. It is the duty of the general manager
to ensure that the requirements of rules pertaining to the track veterinarian are
strictly complied with.
(a) Every racing animal entered to race shall be given a pre-race examination on
the day of the race for which entered to determine the entry’s fitness to race. The
pre-race examination shall be made by the track veterinarian.

1, Horses shall be examined prior to racing. All bandages shall be
removed by the groom and the entry exercised outside the stall so
the track veterinarian can determine the physical condition of the
entry.
2. Racing greyhounds shall be examined by the track veterinarian
at the first weighing-in time, before entry into the lock-out kennel
(Jenny pit).
(b) The track veterinarian shal! observe the condition of all racing animals
immediately prior to, ‘during, and after the race, time permitting. Any racing
animal which has been entered to race that the track veterinarian or division
veterinarian considers to be unsound for racing shall be promptly reported to the
stewards or judges and said animal shall be scratched. ,
4, At all times material hereto, Respondent was the General Manager for the
Jefferson County Kennel Club.
5. Jefferson County Kennel Club is a permitholder authorized to conduct greyhound
racing and pari-mutuel wagering in this state,

7. On September 17, 2005, a track veterinarian was not present for the entire
matinee performance at Jefferson County Kennel Club, and, therefore, did not observe the racing
animals immediately prior to, during, and after the matinee races conducted on September 17,
2005,
8. Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinatian who was present during the matinee performance conducted
on September 17, 2005,

Kennel Club for the matinee performance, and, therefore, did not observe the racing greyhounds
at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit),
11. Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
6.009(2)\(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinarian for the evening performance conducted on September 17,
2005, who examined the racing greyhounds at the first weighing-in time, before the greyhounds
were entered into the lock-out kennel (Jenny Pit).

13. On November 19, 2005, a track veterinarian was not present for the entire evening
performance at Jefferson Couity Kennel Club, and, therefore, did not observe the racing animals
immediately prior to, during, and after the races conducted on Noveinber 19, 2005.
14. Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinarian who was Present during the evening performance conducted
on November 19, 2005,

16. On November 19, 2005, a track veterinarian was not present at Jefferson County
Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds
at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit).
17. Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinarian for the evening performance conducted on November 19,
2005, who examined the racing greyhounds at the first weighing-in time, before the greyhounds
were entered into the lock-out kennel (Jenny Pit),

Club employed a track veterinarian for the evening performance conducted on February 4, 2006,
who examined the racing greyhounds at the first weighing-in time, before the greyhounds were
entered into the lock-out kennel (Jenny Pit).

32. Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
§.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinarian who was present during the evening performance conducted
on February 24, 2006.

98. — Based on the foregoing, as General Manager, Respondent has violated Rule 61D-
6.009(2){a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel
Club employed a track veterinarian for the evening performance conducted on April 22, 2006
who examined the racing greyhounds at the first weighing-in time, before the greyhounds were
entered into the lock-out kennel (Jenny Pit).
WHEREFORE, Petitioner respectfully requests the Division enter an Order imposing one
or more of the following penalties, for each count, as specified in Sections 350.0251(10) and
550. 105@)0), Florida Statutes: revoke or suspend the occupational license of the Respondent;
impose a fine against the Respondent in an amount not exceeding $1,000 for each count; or
impose against the Respondent any combination of such penalties.
