PICKELS, Respondent. / ADMINISTRATIVE COMPLAINT ahi tA LIVE COMPLAINT Department of Business and Professional Regulation, Division of Pari-Mutuel Wagering (hereinafter Petitioner"), files this Administrative Complaint against Council L. Pickels (hereinafter "Respondent"), and says: 1. Petitioner is the state agency charged with regulating the practice of pari-mutuel wagering pursuant to Chapter 350, Florida Statutes, 2. At all times material hereto, Respondent held a pari-mutuel wagering occupational license, number 324100-103 1, issued by the Division. 3. Rule 61D-6.009(2), Florida Administrative Code, provides: Each racing animal permitholder shall employ a veterinarian (the track - or permitholder veterinarian) who is Hcensed by and in good standing with the Florida State Board of Veterinary Medicine. It is the duty of the general manager to ensure that the requirements of rules pertaining to the track veterinarian are strictly complied with. (a) Every racing animal entered to race shall be given a pre-race examination on the day of the race for which entered to determine the entry’s fitness to race. All bandages shall be removed by the groom and the entry exercised outside the stall so the track veterinarian can determine the physical condition of the entry. 2. Racing greyhounds shall be examined by the track veterinarian at the first weighing-in time, before entry into the lock-out kennel (Jenny pit). (b) The track veterinarian shal! observe the condition of all racing animals immediately prior to, ‘during, and after the race, time permitting. Any racing animal which has been entered to race that the track veterinarian or division veterinarian considers to be unsound for racing shall be promptly reported to the stewards or judges and said animal shall be scratched. , 4, At all times material hereto, Respondent was the General Manager for the Jefferson County Kennel Club. 5. Jefferson County Kennel Club is a permitholder authorized to conduct greyhound racing and pari-mutuel wagering in this state, COUNT I 6, Petitioner realleges and incorporates Paragraphs one (1) through five (5) as if fully stated herein. 7. On September 17, 2005, a track veterinarian was not present for the entire matinee performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the matinee races conducted on September 17, 2005, 8. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinatian who was present during the matinee performance conducted on September 17, 2005, MAd O80 add TTETTC6093 TTspl 462 /Te sae ce/9e Fed Ol:tT 2ooz Ts Bny COUNT I 9, Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 10, On September 17, 2005, a track veterinarian was not present at Jefferson County’ Kennel Club for the matinee performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit), 11. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)\(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on September 17, 2005, who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). COUNT I 12. Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein. 13. On November 19, 2005, a track veterinarian was not present for the entire evening performance at Jefferson Couity Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on Noveinber 19, 2005. 14. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was Present during the evening performance conducted on November 19, 2005, MAd O80 add TTETTC6093 TTspl 462 /Te sae cefée Fd Ol:tT 2ooz Ts Bny 15. On November 19, 2005, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 17. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on November 19, 2005, who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit), COUNTY 18, Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 19, On February 4, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on F ebruary 4, 2006, 20. Petitioner realleges and incorporates paragraphs one (1) through five (5) as if filly stated herein. 22, OnFebruary 4, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 23, Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(4)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on February 4, 2006, who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). COUNT Vi 24. ‘Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 25, On February 18, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on February 18, 2006. _26. Club employed a track veterinarian for the evening performance conducted on F ebruary 18, 2006, who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel Genny Pit). . On February 24, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not. observe the racing animals immediately prior to, during, and after the races conducted on February 24, 2006. 32. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- §.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on February 24, 2006. On Febmary 24, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 35. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on February 24, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). | COUNT XT 36, Petitioner realleges and incorporates paragraphs ove (1) through five (5) as if fully stated herein. 37. On February 25, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on February 25, 2006. 38. _ Based on the foregoing, as General Manager, Resp ondent has violated Rule 61D- 6.009(2}(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on February 25, 2006. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6,009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on February 25, 2006, who examined the racing greyhounds at the first weighing-in time, before the greyhounds ‘were entered into the lock-out kennel (Jenny Pit). | COUNT XT 42. On March 4, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kemel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on March 4, 2006. 44. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on March 4, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted ou March 10, 2006. Based on the foregoing, as General Manager, Respondent has Violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Chub employed a track veterinarian who was présent during the weighing-in time to examine the racing greyhounds on March 10, 2006. . On March 11, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on March 11, 2006. 56. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on March 11, 2006. . Based on the foregoing. as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on March 11, 2006, ‘who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). COUNT XIX 60. Petitioner reaileges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 61. On March 18, 2006, a track veterinarian was not present for the entire evening performance at Jefferson County Kennel Club, and, therefore, did not observe the racing animals immediately prior to, during, and after the races conducted on March 18, 2006. 62. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- _ 6,009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on March 18, 2006. Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 67, On March 29, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 68. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 5,009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on March 29, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). Based on the foregoing, as General Manager, Respondent has violated Rule 61D- §.009(2)(b), Florida Administrative Code, by failin gto ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on April 1, 2006, . COUNT XXIiT 72. — Petitioner realleges and incorporates paragraphs one (1) through five (5) as if fully stated herein, 73. On April 1, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing: greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 74. . Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on April 1, 2006 who examined the racing steyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). On April 8, 2006, atrack veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 80. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to’ ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on April 8, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). COUNT XXVI 81. . Based on the foregoing, as General Manager, Respondent has violated Rule 61D- §.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on April 13, 2006. On April 13, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit), 86. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6. 09(28)2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on April 13, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit), COUNT XXvII 87. Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6,009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennet Club employed a track veterinarian who was present during the evening performance conducted on April 15, 2006. On April 15, 2006, a track veterinarian was not present at Jefferson County Kennel Club for the evening performance, and, therefore, did not observe the racing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel Genny Pit). 92, Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on April 15, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit). Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2)(b), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian who was present during the evening performance conducted on April 22, 2006. On April 22, 2006, a track veterinarian was not present at Jeiferson County Kennel Club for the evening performance, and, therefore, did not observe the Tacing greyhounds at the first weighing-in time, before the greyhounds entered the locked-out kennel (Jenny Pit). 98. — Based on the foregoing, as General Manager, Respondent has violated Rule 61D- 6.009(2){a)(2), Florida Administrative Code, by failing to ensure that Jefferson County Kennel Club employed a track veterinarian for the evening performance conducted on April 22, 2006 who examined the racing greyhounds at the first weighing-in time, before the greyhounds were entered into the lock-out kennel (Jenny Pit).
