Pursuant to chapter 626, Florida Statules, you, JONATHAN CRAIG WROTH, are currently licensed in this slate as a resident health agent, and general lines agent. 2, At all times material 1o the dates and occurrences referred to herein, you, JONATITAN CRAIG WROTH, were licensed in this state as a resident health agent, and general lines agent. 3. (“Global”) possess a Certificate of Authority from the Florida Department of Financial Services or the Office of Insurance Regulation to engage in the business of insutance as an insurer. 5, Pursuant to Chapter 626, Florida Statutes, the Florida Department of Financial Services (“Department”) has jurisdiction over your insurance licenses and appointments. COUNT I 6. The above pencral allegations are realleged and incorporated herein by reference. 7. On or around August 2, 2005, you, JONATHAN CRAIG WROTH, sold V.G., of Pompano Beach, Florida, a windstorm insurance policy for his home from Global. 8. Th relation to V.G.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of lirst Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. [Section 626.611(7), Florida Statutes]; (c) Demonstrated lack of reasonably adequate knowledge and technical competence to engage in the transactions authorized by the license or appointment. [Section 626.611(8), Florida Statutes]; (d) Violation of any provision of this Code or any law applicable to the business of insurance in the course of dealing under the licensure or appointment. [Section 626.621(2), Florida Statutes]; and (c) No person shall, ftom offices or by personnel or facilities located in this state. . . directly or indirectly act as agent for, or otherwise represent or aid on behalf of another, any insurer not then authorized to transact such insurance in this state in: (1) The solicitation, negotiation, procurement, or effectuation of insurance or annuity contracts, or renewals thereof; (2) ‘Lhe dissemination of information as to coverage or rates; (3) ‘Lhe forwarding of applications; or (4) The collection or forwarding of premium; or in any other manner represent or assist such an insurer in the transaction of insurance with respect to subjects of insurance resident, located, or to be performed in this state. The above general allegations are realleged and incorporated herein by reference. 10, On or around July 7, 2005, you, IQNATHAN CRAIG WROTH, sold M.C., of Ft. Lauderdale, Slorida, a windstorm insurance policy for his home from Global. 11. In relation to M.C.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to; 1) distributing information, or having information distributed, about an insurance coniract; 2) soliciting, negotialing, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. IT 1S THEREFORE CHARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following provisions of the Florida Insurance Code and Rules of the Department which constitute grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this state, or relative to a subject of insurance resident, Jocated, or to be performed in this state, without complying with the applicable provisions of this Code. On or around June 29, 2005, you, JONATHAN CRAIG WROTH, sold R.P., of Ft. Lauderdale, Florida, a windstorm insurance policy for his home from Global. 14. In relation to R.P.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or eflectuating an insurance 229d WoT: TE BEB2 Fe “EL 2G6P26P8S8: "ON xs SSDINHSS TEIDNENT 4 40 Ldad: WOAs B0:T 800 fe +e contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. Onor around July 8, 2005, you, JONATHAN CRAIG WROTH, sold B.V.1., of Ft, Lauderdale, Florida, a windstorm insurance policy for his home from Global. 17, Tn relation to B.V.1.’s transaction, you, JONATHAN CRAIG WROTII, individually or in your capacity as President of Nirst Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting surance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting; negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. TT IS THEREFORE CHARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following provisions of the Florida insurance Code and Rules of the Department which constitule grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this state, or relative loa subject of itisurance resident, located, or to be performed in this state, without complying with the applicable provisions of this Code, [Section 624.11, Florida Statutes}; (b) Demonstrated lack of fitness or trustworthiness to engage in the business 0 t insurance. The above general allegations arc realleged and incorporated herein by reference. 19, On ot around July 13, 2005, you, JONATHAN CRAIG WROTH, sold V.C., of Pompano Beach, Florida, a windstorm insurance policy for his home from Global. 20, Inrelation to V.C.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the Stale of 226d WOT: TE BEB2 Fe “EL 2G6P26P8S8: "ON xs SSDINHSS TEIDNENT 4 40 Ldad: WOAs 60:7 800 fe +e Florida by, including but not limited lo: 1) distributing information, or having information distributed, aboul an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as lo coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. IT IS THEREFORE CIIARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following provisions of the Florida Insurance Code and Rules of the Department which constitute grounds for the suspension or revocalion of your license(s) and eligibility for licensure: (a) No person shall transact in this state, or relative lo a subject of insurance resident, located, or to be performed in this state, without complying with the applicable provisions of this Code. The above general allegations are realleged and incorporated herein by relerence. 22, On or around July 14, 2005, you, JONATHAN CRAIG WROTHL, sold V.F., of North Miami Beach, Florida, a windslorm insurance policy for his home from Global. 23, In relation to V.F.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectualing an insurance contract; 3) disseminating information as to coverage or tates; 4) forwarding an application, and/or 5) collecting or forwarding premium. IT IS THEREFORE CHARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following, provisions of the Florida Insurance Code and Rules of the Department which constitute grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this slate, or relative to a subject of insurance resident, located, or to be performed in this state, without complying, with the applicable provisions of this Code. ZE/2Td Wet: Ta BEBE Pe EW 2G6P26P8S8: "ON xs SSDINHSS TEIDNENT 4 40 Ldad: WOAs OT: fT 800¢ Pe +e 26. — Inrelation to D.R.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, dircetly or indirectly acted as an apent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectualing an insurance contract; 3) disseminating information as to coverage of rates, 4) forwarding an application; and/or 5) collecting or forwarding premium. ITIS THEREFORE CHARGED that you, JONATHAN CRATG WROTH, have violated or are accountable under the following provisions of the Florida Insurance Code and Rules of the Department which constitute grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this stale, or rclative to a subject of insurance resident, located, or to be performed in this state, without complying with the applicable provisions of this Code. Inrelation to J.V.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indircetly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, aboul an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. In relation to B.B.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of Virst Mlorida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the Stale of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates; 4) forwarding an application; and/or 5) collecting or forwarding premium. IT IS THEREFORE CHARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following provisions of the Florida Insurance Code and Rules of the Department which constitute grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this state, or relative to a subject of insurance resident, located, or to be performed in this state, without complying with the applicable provisions of this Code. On or around July 26, 2005, you, JONATITAN CRAIG WROTH, sold K.St.H., of Miami, Florida, a windstorm insurance policy for his home from Global. 35, In relation to K.StIL.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly or indirectly acted as an agent lor, or otherwise represented or aided, Global in transacting insurance in the State of Horida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rates, 4) forwarding an application; and/or 5) collecting or forwarding premium. In relation to M.A.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of First Florida, directly ot indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the Slate of Horida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, of effectuating an insurance contract; 3) disseminating information as to coverage or rates: 4) forwarding an application; and/or 5) collecting or forwarding premium. IT 18 THEREFORE CHARGED that you, JONATHAN CRAIG WROTH, have violated or are accountable under the following provisions o! the Florida Insurance Code and Rules of (he Department which constitute grounds for the suspension or revocation of your license(s) and eligibility for licensure: (a) No person shall transact in this state, or relative to a subject of insurance resident, located, or to be performed in this state, without complying with the applicable provisions of this Code. Onor around July 6, 2005, you, JONATHAN CRAIG WROTH, sold A.B., of Miami Beach, Florida, a windstorm insurance policy for his home from Global. 44, In relation to A.B.’s transaction, you, JONATHAN CRAIG WROTH, individually or in your capacity as President of F irst Florida, directly or indirectly acted as an agent for, or otherwise represented or aided, Global in transacting insurance in the State of Florida by, including but not limited to: 1) distributing information, or having information distributed, about an insurance contract; 2) soliciting, negotiating, procuring, or effectuating an insurance contract; 3) disseminating information as to coverage or rales, 4) forwarding an application; and/or 5) collecting or forwarding premium.
