STATE OF FLORIDA =r DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION. bn DEPARTMENT OF BUSINESS AND 208 MAY 24 A ll: 09 PROFESSIONAL REGULATION, OK DYTY DIVISION OF Petitioner ADMINISTRATIV , HEARINGS t vs. DBPR Case No.: 2004-056612 ABRAM SUSTAITA, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board of Architecture and Interior Design against ABRAM SUSTAITA ("Respondent"), and says: - 1, Petitioner is the state agency charged with regulating the practice of architecture and interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481, Florida Statutes. 2. The Department of Business and Professional Regulation has jurisdiction over the unlicensed practice of architecture and interior design pursuant to Section 455.227(1)(j), Florida Statutes. 3. Respondent’s address of record is 2825 Wilcrest Drive, Suite 250, Houston, TX 77042. 4. On or about July 25, 2007, a final order was entered requiring the Respondent to pay a $500.00 fine within thirty (30) days. 5. Respondent has failed to comply with the terms of the final order. 6. Section 481.225(1)(a), Florida Statutes, states in pertinent part that disciplinary action may be taken for violating any provision of Section 455.227(1), Florida Statutes. 7. Section 455.227(1)(q), Florida Statutes, provides disciplinary action shail be taken for failing to comply with a lawful order of the board. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing an administrative fine not to exceed $5,000 per count, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 481 and 455, Florida Statutes, and/or the rules promulgated thereunder.
