Counsel for the Petitioner | filed a Notice to Withdraw on August 26, 2008, which was granted by the ALJ on September 10, 2008. After the withdrawal of counsel, Petitioner failed to appear in or acknowledge any further administrative proceedings and no one has made application for appointment as a Qualified Representative on behalf of Petitioner. On October 1, 2008, the Administrative Law Judge (“ALJ”), Larry J. Sartin, assigned by the Division of Administrative Hearings, submitted an Order Closing File, which relinquished jurisdiction to the Florida Department of Revenue (“Department”). A copy of the Order Closing File, issued on October 1, 2008, by the ALJ, which sets forth the procedural history is attached to this order and incorporated herein. The Department has jurisdiction of this cause. Based on the forgoing, it is, ORDERED that this matter is dismissed because of Petitioner’s failure to prosecute. Therefore, the Department's assessment for sales tax, and indigent care surtax, penalties, and accrued interest related to the attached Notices of Proposed Assessment are sustained.
