PROFESSIONAL REGULATION, O \y 7) 0) OTN > py BOARD OF ARCHITECTURE I 52 AND INTERIOR DESIGN, IMISION pp 4 ST ARI Petitioner, “A RINGS *e vs. CASE NO.: 2008-13652 2008-013659 RON RENNER, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board of Architecture and Interior Design against RON RENNER (“Respondent”), and says: 1. Petitioner is the state agency charged with regulating the practice of architecture and interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481, Florida Statutes. 2. The Department of Business and Professional Regulation has jurisdiction over the unlicensed practice of architecture and interior design pursuant to Section 455.227(1)G), Florida Statutes. 3. Respondent’s address of record is 4268 Rainbows End, Stuart, FL 34997. 4. At all times material hereto, Respondent was not duly registered or certified to engage in the practice of interior design in the State of Florida pursuant to Chapter 481, Florida Statutes. 5. Respondent was previously a licensed interior designer in the State of Florida; having been issued license number ID 114. 6. As of March 1, 2003, Respondent’s license was: placed in a delinquent status for failing to renew. 7. As of March 1, 2005, Respondent’s license was placed in a null and void status for failing to renew. 8. As of February 6, 2008, Respondent continues to hold himself out as an interior designer on his website. . 9. Respondent is no longer licensed to practice interior design in the State of Florida and therefore cannot use the title interior designer. 10. Respondent is the founder of Certified Interior Decorators International. 11. Respondent’s web site claims that an interior decorator can provide design services for a business, restaurant, and hospitality interiors. 12. In the State of Florida, only licensed interior designers can provide design services for commercial projects. 13. Respondent is advising interior decorators to practice the profession of interior design without a license in violation of Chapter 481, Florida Statutes. COUNT I 14. Petitioner hereby realleges and incorporates paragraphs one (1) through thirteen (13) as if fully set forth herein, 15. Section 481.223(1)(c), Florida Statutes, prohibits a person from using the title interior designer or words to that effect unless the person is a registered interior designer. 16. Based upon the foregoing, the Respondent has violated Section 481.223(1)(c), Florida Statutes, by holding himself out as interior designer when he was not the holder of a valid license. COUNT II 17. Petitioner hereby realleges and incorporates paragraphs one (1) through thirteen (13) as if fully set forth herein. 18. Section 455.227(1)(j), Florida Statutes, prohibits aiding, assisting, procuring, employing, or advising any unlicensed person or entity to practice a profession contrary to this chapter, the chapter regulating the profession, or the rules of the department or the board. 19. Based upon the foregoing, Respondent has violated Section 455.227(1)(), Florida Statutes, by assisting interior decorators in their performance of unlicensed activity contrary to Chapter 481, Florida Statutes. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing an administrative fine not to exceed $5,000 Per count, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 481 and 455, Florida Statutes, and/or the rules promulgated thereunder.
