ADMINISTRATIVE COMPLAINT
Petitioner, Jeanine Blomberg, as Commissioner of Education, files this Administrative
Comiplaint against ELIZABETH ROSS PATE. The Petitioner seeks the appropriate disciplinary
sanction of the Respondent’s educator’s certificate pursuant to Sections 1012.795 and 1012.796,
Florida Statutes, and pursuant to Rule 6B-1.006, Florida Administrative Code, Principles of
Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth
in Sections 1012.795(1) and 1012.796(7), Florida Statutes.
The Petitioner alleges:
JURISDICTION
1. The Respondent holds Florida Educator’s Certificate 883930, covering the area of
Educational Media Specialist, which is valid through June 30, 2009.
2. At all times pertinent hereto, the Respondent was employed as a Media Specialist
at Edison and Lopez Elementary Schools in the Hillsborough County Schoo! District.
MATERIAL ALLEGATIONS
3. The Respondent failed to perform her teaching duties professionally, efficiently and
effectively during the 2003-2004 and 2004-2005 school years.
4, The Respondent's teaching performance was reviewed and found to be unsatisfactory
in her annual evaluation dated March 30, 2004, in that the Respondent was rated unsatisfactory in
the following areas:
(a) pianned lessons consistent with state and district curriculum frameworks;

(b) completed media records and reports accurately, up to date and on time;
(c) punctual in reporting to school and in carrying out school assignments;
(d) adhered to state, district, and school policies and procedures;
(e) performed with a minimum of supervision;
(f) demonstrated skill in budgeting funds.
The Respondent's teaching performance was reviewed and found to be unsatisfactory
in an evaluation dated November 16, 2004, in that the Respondent was rated unsatisfactory in the
following areas:
objectives;
curriculum;
(a) planned lessons consistent with state and district curriculum frameworks;
(b) supported district and school goals;
(c) assisted teachers in selecting approptiate media for units of support of lesson
(d) selected appropriate resource materials, programs and displays related to school
(e) selected resource materials, programs, and displays that include cultural
contributions of various groups;

(£) adhered to state, district, and school policies and procedures;
(g) completed media records and reports accurately, up to date and on time;
(bh) punctual in reporting to school and in carrying out school assignments;
(i} performed with a minimum of supervision;
(j) demonstrated logical thinking and made practical decisions;
(k) responded reasonably and acted appropriately upon constructive criticism;
(1) demonstrated knowledge of theories, techniques and skills in the field of library

(m) utilized physical facilities effectively;
(n) provided an atmosphere conducive to individual inquiry; small group activities,
research, study and relaxation;
(0) reviewed with departments and/or individual teachers and students the procedures
for group and/or individual assignments;
(p) conducted in services sessions for staff members in the production and use of
media, multimedia, and technology;
(q) prepared lists of newly acquired print and non-print media and multimedia
equipment in a timely manner;
(r) presented subject matter effectively and with enthusiasm, while using appropriate
strategies for teaching students from diverse cultural backgrounds, with different learning styles and
with special needs;
(s) checked for comprehension during instruction, using both traditional and
alternative forms of assessment of student leaming;
(t) built and maintained a balanced comprehensive collection of print media, non-
print media, multimedia and technoiogy;
(u) demonstrated skill in budgeting funds and adhered to budget deadlines; and
(v) provided assistance for production services while adhering to copyright
guidelines.
6. The Respondent's teaching performance was reviewed and found to be unsatisfactory
in an annual evaluation dated April 26, 2005, in that the Respondent was rated unsatisfactory in the
following areas:
(a) planned lessons consistent with state and district curriculum frameworks;
(b) supported district and school goals;
(c) assisted teachers in selecting appropriate media for units of support of lesson
objectives;
(d) selected appropriate resource materials, programs and displays related to school
curriculum;

(e) selected resource materials, programs, and displays that include cultural
contributions of various groups;
(f) adhered to state, district, and school policies and procedures;
(g) completed media records and reports accurately, up to date and on time;

(i) performed with a minimum of supervision;
(j) demonstrated logical thinking and made practical decisions;
(k) responded reasonably and acted appropriately upon constructive criticism;

The Petitioner charges:
STATUTE VIOLATIONS
COUNT i: The Respondent is in violation of Section 1012.795(1){b), Florida Statutes,
in that Respondent has proved to be incompetent to teach or to perform duties as an employee of the
public school system or to teach in or to operate a private school.
COUNT 2: The Respondent is in violation of Section 1012.795(1)(), Florida Statutes,
in that Respondent has been found guilty of personal conduct which seriously reduces her
effectiveness as an employee of the school board.
WHEREFORE, based on the reasons set forth herein and in accordance with ihe
Explanation of Rights and Election of Rights forms attached to and made a part of this
Administrative Complaint, Petitioner respectfully recommends that the Education Practices
Commission impose an appropriate sanction against the Respondent’s educator’s certificate pursuant
to the authority provided in Sections 1012.795(1) and 1012.796(7), Florida Statutes. The sanctions
imposed by the Education Practices Commission may include, but are not limited to, any one or a
combination of the following: issuing the Respondent a written reprimand; placing the Respondent
on probation for any period of time; restricting the Respondent’s authorized scope of practice;
assessing the Respondent an administrative fine; directing the Respondent to enroll in the Recovery
Network Program; suspending the Respondent’s educator’s certificate for a period of time not to
exceed five years; revoking the Respondent’s educator’s certificate for a period of time up to 10
years or permanenitly; or barring the Respondent from reapplying for an educator’s certificate for
a period of time up to 10 years or permanently.
