DBPR Case NO. 2009006963 ROBERT GEORGE HANSEN, Respondent. / ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (“Petitioner”) files this Administrative Complaint against Robert George Hansen (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate sales associate, issued license number H:\ac\hansen.doc FDBPR v. Robert George Hansen Case No. 2009006963 Administrative Complaint 3103924 in accordance with Chapter 475 of the Florida Statutes. 3. The last license issued was as an active sales associate with The Biscayne Group, Inc., 690 SW 1st Court #1014, Miami, Florida 33130. 4, “Broker” means a person who, for another, and for a compensation or valuable consideration directly or indirectly paid or promised, expressly or impliedly, or with an intent to collect or receive a compensation or valuable consideration therefore, appraises, auctions, sells, exchanges, buys, rents, or offers, attempts or agrees to appraise, auction, or negotiate the sale, exchange, purchase, or rental of business enterprises or business opportunities or any real property or any interest in or concerning the same, including mineral tights or leases, or who advertises or holds out to the public by any oral or printed solicitation or representation that she or he is engaged in the business of appraising, auctioning, buying, selling, exchanging, leasing or renting business enterprises or business opportunities or real property of others or interests therein, including mineral rights, or who takes any part in the procuring of sellers, purchasers, lessors, or lessees of business enterprises or business opportunities or the real property of another, or leases, or interest therein, including mineral rights, or who directs or assists in the procuring of prospects or in the negotiation or closing of any transaction which does, or is calculated to, result in a sale, exchange, or leasing thereof, and who receives, expects, or is promised any compensation or valuable consideration, directly or indirectly therefore; and all persons who advertise rental property information or lists. See Florida Statute 475.01(1) (a). 5. “Sales associate” means a person who performs Pp any act specified in the definition of “broker”, but who performs such act under the direction, control or management of another person. Since April 15, 2009, Respondent has been a sales associate employed with Biscayne Group, Inc., located at 690 SW 1st Court #1014, Miami, FL 33130. 7. On May 14, 2009, Respondent, via email, advertised the following properties for sale: A) 12410 E. None of the real estate advertisements placed by the Respondent included the licensed name of the brokerage firm he works for. 11. Respondent failed to advertise these properties under the direction, control or management of the brokerage firm he worked for. 12. Respondent did not have an ownership interest in any of the properties he advertised. 13. Respondent advertised said properties for the purpose of collecting a commission or compensation. COUNT ONE Based upon the foregoing, Respondent is guilty of having operated as a broker while licensed as a sales associate in violation of Section 475.42(1)(b), Florida Statutes and, therefore, in violation of Section 475.25(1) (e), Florida Statutes. COUNT TWO Based upon the foregoing, Respondent is guilty of having failed to advertise property or services in a manner in which reasonable persons would know they are dealing with a real estate licensee; H:\ac\hansen.doc 5 FDBPR v. Robert George Hansen Case No. 2009006963 Administrative Complaint failed to include the licensed name of the brokerage firm; and having placed or caused to be placed an advertisement which is fraudulent, false, deceptive, or misleading in form or content in violation of Rule 6132-10.025 of the Florida Administrative Code and Section 475.25(1)(c), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an administrative fine of up to $5,000 for each count or offense; imposition of investigative costs; issuance of a reprimand; imposition of probation subject to terms including, but not limited to, requiring the licensee, registrant or permittee to complete and pass additional real estate education courses; publication; or any combination of the foregoing which may apply.
