ADMINISTRATIVE COMPLAINT State of Florida, Department of Business and Professional Regulation, Division of Real Estate (‘Petitioner’) files this Administrative Complaint against Frances Gail Gee (*Respondent” ) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. The last license issued was as an active broker at Tradewinds of Mandalay, Inc., 19 Hwy. 40 West, Inglis, Florida 34449. 4. Respondent introduced Cara Shafer Cacioppo to Bruce Sculthorpe (Buyer) as a real estate agent employed with Respondent, the broker for Tradewinds of Mandalay Inc., (Tradewinds) . 5. Respondent knew or should have known that Cara Shafer Cacioppo, is not now, nor was at any time material herein, registered as a licensed real estate sales associate or broker in the state of Florida. 6. Respondent represented to Buyer that Cacioppo was a licensed real estate agent in the state of Florida. 7. On or about August 1, 2005 Respondent knew or should have known that Cacioppo, as an agent for Tradewinds, negotiated for Bruce & Julie Sculthorpe the sale of Subject Property 1 for $70,000 to Gustavo & Nathalie Roperto. A copy of the HUD is attached hereto and incorporated herein as Administrative Complaint Exhibit 1. 8. Respondent knew or should have known that Cacioppo negotiated for a real estate commission paid to Trade Wind for $2,800. Respondent represented in all sales and purchase documents that broker Gee was the agent representing the Buyer. 11. Respondent knew or should have known that Cacioppo was at all times material, in bringing together Buyer and Seller for the sale and purchase of the Subject Property 1, with the intention that Respondent and broker Gee would receive compensation or valuable consideration, directly or indirectly, paid or promised, expressly or implied, for the transaction. 12. At all times material, Respondent had no title or any other interest in the Subject Property. COUNT ONE Based upon the foregoing, Respondent is guilty of aiding, assisting, procuring, employing, or advising any unlicensed person or entity to practice a profession contrary to Chapter 455, 475 or the rules of the Petitioner in violation of Section 455.227(1) (j), Florida Statutes and, therefore, in violation of Section 475.25(1) (e), Florida Statutes. On or about August 1, 2005 Respondent knew or should have known that Cacioppo, as an agent for Tradewinds, negotiated for Bruce and Julie Sculthorpe the sale of a property known as Lot 206, Watermans Subdivision, Crystal River, FL 34429 (Subject Property 2) for $160,000 to St. Lucie Development Corp. A copy of the HUD is attached hereto and incorporated herein as Administrative Complaint Exhibit 2. 15. Respondent knew or should have known that Cacioppo negotiated for a real estate commission paid to Trade Wind for $6,400. 16. Respondent knew or should have known that Cacioppo was the person dealing with the Buyer in all matters pertaining to the sale of Subject Property 2. 17. Respondent represented in all sales and purchase documents that Respondent was the agent representing the Buyer. 18. At all times material, Respondent had no title or any other interest in the Subject Property. COUNT TWO Based upon the foregoing, Respondent is guilty of aiding, assisting, procuring, employing, or advising any unlicensed person or entity to practice a profession contrary to Chapter 455, 475 or the rules of the Petitioner in violation of Section 455.227(1) (j), Florida Statutes and, therefore, in violation of Section 475.25(1)(e), Florida Statutes. On or about August 7, 2005 Respondent knew or should have known that Cacioppo, as an agent for Tradewinds, negotiated for Bruce & Julie Sculthorpe the sale of a property known as Lot 207, Watermans Subdivision, Crystal River, FL 3442 (Subject Property 3) for $160,000 to Orion Property and Sales Inc. At all times material, Respondent had no title or any other interest in the Subject Property. Petitioner realleges and incorporates herein Paragraphs One through Six above. 28. On or about September 20, 2005 Respondent knew or should have known that Cacioppo, as an agent for Tradewinds, negotiated for Bruce & Julie Sculthorpe the purchase of a property known as 1106 S, Ozello Trail, Citrus County, FL 3442 (Subject Property 4) for $285,000. A copy of the contract is attached hereto and incorporated herein as Administrative Complaint Exhibit 4. 29, Respondent knew or should have known that Cacioppo negotiated for a real estate commission of 3% of the purchase price paid to Tradewind. 30. Respondent knew or should have known that Cacioppo was the person dealing with the Buyer in all matters pertaining to the sale of Subject Property 4. 31. Respondent represented in all sales and purchase documents that Respondent was the agent representing the Buyer. 32. At all times material, Respondent had no title or any other interest in the Subject Property. COUNT FOUR Based upon the foregoing, Respondent is guilty of aiding, assisting, procuring, employing, or advising any unlicensed person or entity to practice a profession contrary to Chapter 455, 475 or the rules of the Petitioner in violation of Section 455.227(1) (j),- Florida Statutes and, therefore, in violation of Section 475.25(1) (e), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged.
