CASE NO: DOE-2010-1983 LEADERSHIP ACADEMY (5159), Respondent. / ADMINISTRATIVE COMPLAINT 2e%4 Wd 1-634 01 this Administrative Complaint against Leadership Academy (5159) (“Respondent” or “Leadership Academy”) pursuant to Sections 120.569, 120.57, 1002.39, 1002.39(7), 1002.42, and 1002.421, Florida Statutes (“F.S.”); and Rules 6A-6.03315 and 6A-6.0970, Florida Administrative Code (“F.A.C.”). The Petitioner revokes Respondent’s participation in the John M. McKay Scholarships for Students with Disabilities Program (“McKay”) and imposes other appropriate sanctions as provided by law. Petitioner alleges: JURISDICTION 1. At all times pertinent hereto, Respondent was a private school participating in the John M. McKay Scholarships for Students with Disabilities Program (“McKay Scholarship Program”) providing services to eligible students pursuant to § 1002.39, 1002.42, and 1002.421, F.S.; and Rules 6A-6.03315, 6A-6.0970, F.A.C. 2. At all times pertinent hereto, Respondent has operated Leadership Academy at 2099 West Prospect Road, Tamarac, Florida; 5420 N State Road 7, Tamarac, Florida; and 2351 NW 26th Street, Oakland Park, Florida. 3. As a private school participating in the McKay Scholarship Program, Respondent is required to continually comply with all laws relating to the general regulation of private schools. § 1002.421(1), F.S.; Rules 6A-6.03315, and 6A- 6.0970(6)(c)-(d), F.A.C. 4. Petitioner is responsible for the implementation and operation of the McKay Scholarship Program. § 1002.39, 1002.42, and 1002.421, F.S.; Rules 6A-6.03315 and 6A-6.0970, F.A.C. 5. As part of that responsibility, Petitioner is required to ensure that private schools participating in the McKay Scholarship Program continually comply with all state laws relating to general regulation of private schools. § 1002.39(6)-(7), 1002.42(2), and 1002.421(2), F.S.; Rule 6A-6.0970(7)-(9), F.A.C. 6. Petitioner also has the authority to suspend or revoke a private school’s participation in this program if Petitioner determines that the private school has failed to comply with the McKay Scholarship Program requirements or has otherwise engaged in unlawful activity. § 120.569, 120.57, 1002.39, 1002.39(7), F.S.; 1002.42, and 1002.421, F.S.; Rules 6A-6.03315, 6A-6.0970, and 6A-6.0970(7), F.A.C. MATERIAL ALLEGATIONS McKay Scholarship Program 7. The Department re-alleges paragraphs 1-6. 8. The McKay Scholarship Program affords a disabled student the option of attending a different public school from the one to which he is assigned, or, if he is eligible, the opportunity to receive a scholarship to defray the cost of attending a private school of choice. Winn v. Muskateer’s Academy, Ine, Recommended Order Finding of Fact #9, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, F.S.; and Rule 6A-6.0970, F.A.C. 9. Once awarded, a McKay scholarship remains in force until the student returns to public school, graduates, or turns 22, whichever first occurs; provided, however, that he/she does not drop out, which would render the student ineligible for the scholarship. Id. 10. To participate in the McKay Scholarship Program, a private school must meet certain conditions. McKay scholarship funding is potentially available to most private schools operating lawfully in the state, for the program is designed to be inclusive in this regard. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #10, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, 1002.42, and 1002.421, F.S.; Rules 6A-6.0970, and 6A-6.03315, F.A.C, 11. A private school that wants to participate in the McKay Scholarship Program must notify the Department of its interest and submit information demonstrating compliance with the eligibility requirements. This information — and other data necessary to secure the disbursement of scholarship funds.— must be transmitted to the Department electronically, through forms available online to registered users, at a secure Web site maintained by the Department. To access this site, a private school must first obtain a unique code and establish a confidential password, both of which must be entered correctly in order to logon to the Department’s secure Web page. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #11, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, 1002.42, and 1002.421, F.S.; Rules 6A-6.0970, and 6A- 6.03315, F.A.C. , 12. If the parent of an eligible student chooses the private school option and secures a place for his child at the private school of choice, then the parent must notify the Department of his decision before the child begins attending the private school. After receiving such notice, the Department verifies the student’s enrollment in the private school, obtains from the private school a schedule of the tuition and fees, and receives from the student’s school district a “matrix of services” reflecting the student’s special educational needs. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #12, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, F.S.; and Rule 6A- 6.0970, F.A.C. 13. The maximum amount of the McKay scholarship for a particular student is the: lesser of (a) the “calculated amount” (which is roughly equal to the estimated cost of educating the student in the public school to which he is assigned) or (b) the actual amount of the private school’s tuition and fees. The amount of the student’s scholarship is deducted from his public school district’s total funding entitlement. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #13, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, F.S.; and Rule 6A-6.0970, F.A.C. 14. McKay scholarship payments are made in four equal amounts during the school year to which the scholarship applies. The payment dates are September 1, November 1, February 1, and April 1. Payments are made by warrant payable to the student’s parent. The Department mails each warrant to the private school of the parent’s choice. The parent is required to restrictively endorse the warrant, authorizing the funds to be deposited only in the private school’s account. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #14, DOB-2006-1243, DOAH 06-5074; See, § 1002.39, and1002.421, F.S.; and Rule 6A-6.0970, F.A.C. 15. To remain eligible for the McKay scholarship, the student must have regular and direct contact with his teacher(s) at the private school’s physical location. Thus, ahead of each payment (after the initial payment’), the private school must verify, through the Department’s secure, password-protected Web site, that the student continues to be enrolled in, and to attend, the private school. Winn v. Muskateer’s Academy, Inc., Recommended Order Finding of Fact #15, DOE-2006-1243, DOAH 06-5074; See, § 1002.39, and 1002.421, F:S.; and Rule 6A-6.0970, F.A.C. 16. . Itis in connection with these ongoing duties that Respondent violated applicable law. On various dates between the 2007/2008 school year and the 2008/2009 school year, at least 8 students in question were enrolled and/or attended Leadership Academy. These students never attended, subsequently graduated, withdrew or otherwise stopped attending Leadership Academy. However, Respondent continued to verify to the Department — on a quarterly basis through a password-protected Web site — that these students were still enrolled and attending Leadership Academy, and were otherwise still eligible for the McKay Scholarship Program. 17. Respondent intentionally reported to the Department that these students had re- enrolled (or continued to attend) at Leadership Academy, while either (a) knowing that " The first McKay scholarship warrant is provided based on a private school’s enrollment of the student for that school year. Rule 6A-6.0970(5)(c)1.-2., F.A.C. this representation of material fact was false or (b) recklessly disregarding the truth or falsity of such. Respondent claimed and received McKay Scholarship Program warrants on behalf of these students.” Student “A” Respondent Claimed An Ineligible Student During The 2007/2008 School Year (No Regular & Direct Contact) 18. The Department re-alleges paragraphs 1-17. 19. On August 2, 2007, Respondent verified to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2007/2008 school year, and that the student would resume attending the school on September 4, 2007. 20. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,500.00. 21. On November 7, 2007; January 9, 2008; and March 3, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 22. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2007, November 2007, February 2008 ($1,406.75), and April 2008 ($1,350.75). 23. Upon request, Respondent provided sufficient evidence of regular and direct contact to justify the September 2007 and November 2007 payments; however, Respondent failed to submit any evidence of regular and direct contact to justify the February 2008 and April 2008 warrants. ? Attached and incorporated by reference is a synopsis with supporting documentation from the Department’s Office of Inspector General pursuant to their investigation. 24, The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. 25. Regular and direct contact is “a program of instruction that provides for a minimum of one hundred and seventy (170) actual school instruction days with the required instructional hours (determined by grade level per state board Rule 6A-1.09512, F.A.C.) under the direct instruction of the private school teacher at the school’s physical location with occasional off-site activities under the supervision of the private school teacher.” Rule 6A-6.03315(1)(c), F.A.C. 26. Aschool’s physical location is “the location where regular and direct contact with the private school teacher occurs and must meet applicable state and local health, safety, and welfare, laws, codes and rules.” Rule 6A-6.03315(1)(d), F.A.C. Respondent Claimed An Ineligible Student During The 2008/2009 School Year (No Regular & Direct Contact) 27. The Department re-alleges paragraphs 1-26. 28. On June 8, 2008, Respondent verified to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. 29. | Onthe same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 30. On October 7, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 31. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). Upon request of the Department, Respondent did not submit any evidence of regular and direct contact to justify the September 2008 and November 2008 warrants. Student “B” Respondent Claimed An Ineligible Student During the 2008/2009 School Year (The Student Graduated) 36. The Department re-alleges paragraphs 1-35. 37. The student enrolled and attended Leadership Academy from September 2007 until May 2008, when the student graduated and received a diploma. The student did not attend Leadership Academy after graduation in May 2008. 38. On July 5, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. 39. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 40. On October 7, 2008, and January 6, 2009, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 41. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 42. Graduation from high school terminates a McKay scholarship. § 1001.39(4)(a), FS. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 43. The Department re-alleges paragraphs 1-42. 44. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Failed to Obtain Restrictive Endorsements Of McKay Scholarship Warrants 45. The Department re-alleges paragraphs 1-44. 46. During the course of the Department’s investigation, the student’s mother teviewed the restrictive endorsements on the applicable warrants. The mother stated under oath that she did not sign the following McKay scholarship vvarrants: September 2008 (#9401996080); and November 2008 (#9404435000). 47. Respondent forged, or had forged, the restrictive endorsement of the parent on the McKay scholarship warrants. 48. Respondent must require a parent to restrictively endorse McKay Scholarship Program warrants. § 1002.39(9)(f), F.S.; and § 1002.421(2)(f)2., F.S. Student “C” Respondent Claimed An Ineligible Student During the 2007/2008 School Year (No Regular & Direct Contact) 49. The Department re-alleges paragraphs 1-48. 50. In the summer of 2007, the student’s mother was contacted by Respondent and filled out paperwork to see if the student would qualify for a McKay scholarship. This student never attended Respondent’s school. On September 10, 2007, the student moved to Greensboro, North Carolina, and enrolled and attended Northern Middle School on or about October 10, 2007. 51. On August 2, 2007, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had enrolled in Leadership Academy for the 2007/2008 school year, and that the student would start attending the school on September 4, 2007. 52. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,500.00. 53. On November 7, 2007, and March 3, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 54. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2007 ($3,961.25), November 2007 ($3,961.25), and April 2008 ($3,723.75). 55. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 56. The Department re-alleges paragraphs 1-55. 57. On June 8, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would start attending the school on August 18, 2008. 58. | On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 59. On October 7, 2008, and January 6, 2009, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 60. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($3,725.75), and November 2008 ($3,725.75). 61. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Failed To Obtain Restrictive Endorsements Of McKay Scholarship Warrants 62. The Department re-alleges paragraphs 1-61. 63. During the course of the Department’s investigation, the student’s mother reviewed the restrictive endorsements on the applicable warrants. The mother stated under oath that she did not sign the following McKay scholarship warrants: September 2007 (#8403838560), November 2007 (#84066776760), April 2008 (#8411798820), September 2008 (#9401996160), and November 2008 (#9404435070). 64. — Respondent forged, or had forged, the restrictive endorsement of the parent on the McKay scholarship warrants. 65. Respondent must require a parent to restrictively endorse McKay Scholarship Program warrants. § 1002.39(9)(f), F.S.; and § 1002.421(2)(N2., F.S. Student “D” Respondent Claimed An Ineligible Student In 2008/09 School Year (No Regular & Direct Contact) 11 66. The Department re-alleges paragraphs 1-65, 67. On August 2, 2007, the student enrolled in Leadership Academy and started attending on September 4, 2007. In May 2008, the student withdrew from Leadership Academy. The student did not attend Leadership Academy after this date. On June 8, 2008, the student moved to Rock Hill, South Carolina, enrolling in and attending Rock Hill High School in August 2008. After moving to South Carolina, Respondent contacted the student’s mother to confirm whether the student would be attending Leadership Academy for the 2008/2009 school year. The mother explained that the student moved to South Carolina and would not be attending Leadership Academy. 68. On June 8, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would attend the school starting August 18, 2008. 69. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 70. On October 7, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 71. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 72. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Failed to Obtain Restrictive Endorsements Of McKay Scholarship Warrants 73. The Department re-alleges paragraphs 1-72. 74. During the course of the Department’s investigation, the mother reviewed the restrictive endorsements of the warrants for her child. The mother stated under oath that she did not sign McKay scholarship warrants for her son for September 2008 (#9401995810), and November 2008 (#9404434720). 75. Respondent forged, or had forged, the restrictive endorsement of the parent on the McKay scholarship warrants. 76. Respondent must require a parent to restrictively endorse McKay Scholarship Program warrants. § 1002.39(9)(f), F.S.; and § 1002.421(2)(f)2., F.S. Student “E” Respondent Claimed An Ineligible Student During the 2008/2009 School Year (The Student Graduated) 77. The Department re-alleges paragraphs 1-76. 78. The student enrolled and attended Leadership Academy from September 2007 until May 2008, when the student graduated and received a diploma. The student did not attend Leadership Academy after graduation in May 2008. 79. On June 8, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. 80. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 13 81. On October 7, 2008, and January 6, 2009, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 82. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 83. Graduation from high school terminates a McKay scholarship. § 1001.39(4)(a), FS. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 84. | The Department re-alleges paragraphs 1-83. 85. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Failed to Obtain Restrictive Endorsements Of McKay Scholarship Warrants 86. The Department re-alleges paragraphs 1-85. 87. During the course of the Department’s investigation, the mother reviewed the restrictive endorsements of the warrants for her child. The mother stated under oath that she did not sign McKay scholarship warrants for her son for September 2008 (#9401995640), and November 2008 (#9404434520). 88. Respondent forged, or had forged, the restrictive endorsement of the parent on the McKay scholarship warrants. 89. Respondent must require a parent to restrictively endorse McKay Scholarship Program warrants. § 1002.39(9)(f), F.S.; and § 1002.421(2)(f)2., F.S. 14 Student “F” Respondent Claimed An Ineligible Student During the 2007/2008 School Year (No Regular & Direct Contact) 90. The Department re-alleges paragraphs 1-89, 91. On August 2, 2007, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had enrolled in Leadership Academy for the 2007/2008 school year, and that the student would resume attending the school on September 4, 2007. | 92. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,500.00. 93. On January 9, 2008, and March 3, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 94. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for February 2008 ($1,406.75), and April 2008 ($1,350.75). 95. Upon request of the Department for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 96. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 97. The Department re-alleges paragraphs 1-96. 98. On June 7, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. , 99. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 100. On October 7, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 101. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 102. Upon the Department’s request for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 103. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Student “G” Respondent Claimed An Ineligible Student During the 2007/2008 School Year (No Regular & Direct Contact) 104. The Department re-alleges paragraphs 1-103. 105. On August 2, 2007, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had enrolled in Leadership Academy for the 2007/2008 school year, and that the student would resume attending the school on September 4, 2007. 106. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,500.00. 107. On January 9, 2008, and March 3, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 108. Based on Respondent's verifications, Respondent received the student’s McKay scholarship warrants for February 2008 ($1,406.75), and April 2008 ($1,350.75). 109. Upon request of the Department for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 110. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 111. The Department re-alleges paragraphs 1-110. 112. On June 8, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. 113. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 17 114. On October 7, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 115. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 116. Upon request of the Department for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 117. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Student “H” Respondent Claimed An Ineligible Student During the 2007/2008 School Year (No Regular & Direct Contact) 118. The Department re-alleges paragraphs 1-117. 119. On August 2, 2007, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had enrolled in Leadership Academy for the 2007/2008 school year, and that the student would resume attending the school on September 4, 2007. 120. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,500.00. 121. On January 9, 2008, and March 3, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 18 122. Based on Respondent’s verifications, Respondent received the student’s McKay Scholarship warrants for February 2008 ($1,406.75), and April 2008 ($1,350.75). 123. Upon request of the Department for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 124. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), FS. Respondent Claimed An Ineligible Student During the 2008/2009 School Year (No Regular & Direct Contact) 125. The Department re-alleges paragraphs 1-124. 126. On June 8, 2008, Respondent reported to the Department, through the Department’s secure, password-protected Web site, that the student had re-enrolled in Leadership Academy for the 2008/2009 school year, and that the student would resume attending the school on August 18, 2008. 127. On the same date and in the same manner, Respondent reported that the student’s tuition and fees for the upcoming school year would total $22,300.00. 128. On October 7, 2008, Respondent verified the student’s attendance through the Department’s secure, password-protected Web site. 129. Based on Respondent’s verifications, Respondent received the student’s McKay scholarship warrants for September 2008 ($1,367.00), and November 2008 ($1,367.00). 19 130. Upon request of the Department for proof, Respondent has failed to demonstrate that the student had regular and direct contact with the private school’s teachers at the school’s physical location. 131. The failure of a student to have regular and direct contact with his private school’s teachers at the school’s physical location renders the student ineligible for the McKay Scholarship Program. § 1002.39(3)(h), F.S. Sum of Funds Fraudulently Obtained 132. The Department re-alleges paragraphs 1-131. 133. As aresult of Respondent’s activities noted above, beginning in the 2007/2008 school year and continuing through and including the 2008/2009 school year, Respondent fraudulently obtained at least $49,265.75 in McKay Scholarship Program funds for at least 8 different students. More specifically, during the: a. 2007/2008 school year, Respondent fraudulently obtained McKay Scholarship Program funds for at least 5 students in the amount of approximately $22,676.25; and b. 2008/2009 school year, Respondent fraudulently obtained McKay Scholarship Program funds for at least 8 students in the amount of approximately $26,589.50. Private schools are responsible for the return of all scholarship funds to the Department that are received in error, including for students that were not in attendance. Rule 6A- 6.0970(5)(d), F.A.C. On April 24, 2009, the Department notified Respondent that the above referenced students were not in attendance at Leadership Academy during the time 20 periods identified herein; however, Respondent has made no restitution of these McKay Scholarship Program funds to the Department.” Respondent Failed To Comply The General Regulation Of Private Schools 134. The Department re-alleges paragraphs 1-133. 135. Since the inception of and its participation in the McKay Scholarship Program, Respondent has been under the continuing obligation to comply with all state laws relating to the general regulation of private schools. § 1002.421(1), F.S., Rules 6A- 6.03315, and 6A-6.0970(6)(c)-(d), F.A.C. 136. For the 2007/2008 and 2008/2009 school years, Respondent has failed to comply with these laws in the following material ways with regard to at least these 8 different students for which McKay Scholarship Program funds were paid, in that the required information was not maintained at all or, if maintained, was fraudulent. See, § 1002.42(4), and 1003.23(2), F.S. Respondent has failed to: a. properly report in the annual private school survey student enrollment by grade or special group, as well as student attendance and reports; b. keep and properly report student attendance records and reports; and c. maintain permanent and temporary student records. Respondent Falsified The Annual Private School Scholarship Compliance Form 137. The Department re-alleges paragraphs 1-136. 138. Each school year, Respondent is required to submit to the Department the SCF-1. § 1002.42, F.S.; Rule 6A-6.03315, F.A.C, 2 Even if Respondent makes full restitution of such funds, due to the volume and nature of Respondent’s actions, the Department will still terminate Respondent’s eligibility to participate in the McKay Scholarship Program. 21 139. As part of the SCF-1, Respondent has affirmatively stated as to each student for whom it claimed was enrolled in the McKay Scholarship Program that the following information was maintained — all the while knowing that the statement was false or, if the information was maintained, fraudulent as to some or all of at least 8 students: a. that Respondent maintained student records containing permanent information as defined in § 1002.42(3)(a)2.a., F.S., to include: student’s full name; authenticated birth date, place of birth, race and sex; last known address of student; names of student’s parents; name and location of last school attended; number of days present and absent; date enrolled; date withdrawn; courses taken and record of achievement; and date of graduation or program achievement. b. that Respondent maintained a register of student enrollment and daily attendance, open for inspection by the designated school representative or the district school superintendent of the district in which the school is located, as required by § 1003.23(2), F.S. Petitioner charges: STATUTORY/RULE VIOLATIONS COUNT 1: Respondent is in violation of § 1002.421(1), F.S., in that Respondent has failed to comply with laws relating to the general regulation of private schools. COUNT 2: Respondent is in violation of § 1002.39(5)(D), and 1002.421(2)(£)2., F.S., in that Respondent has failed to require parents to restrictively endorse McKay Scholarship Program warrants to Respondent. 22 COUNT 3: Respondent is in violation of § 1002.42(2), F.S., in that Respondent has failed to properly report in the annual private school survey student enrollment by grade or special group, as well as student attendance records and reports. COUNT 4: Respondent is in violation of § 1002.42(2)(g), F.S., in that Respondent has submitted data for a nonexistent school or an institution providing no instruction or training, the purpose of which is to defraud the public. COUNT 5: Respondent is in violation of § 1002.42(3), F.S., in that Respondent has failed to maintain permanent and temporary student records. COUNT 6: Respondent is in violation of § 1002.42(4), F.S., in that Respondent has failed to keep student attendance records and reports. COUNT 7: Respondent is in violation of § 1002.39(3)(h) and (8)(d), F.S., and Rule 6A-6.03315(1)(c)-(d), F.A.C., in that Respondent claimed students who did not have regular and direct contact with the private school’s teachers at the school’s physical location. COUNT 8: Respondent is in violation of § 1002.39(4)(a), F.S., and Rule 6A- 6.0970(3)(b), F.A.C., in that Respondent claimed students who previously graduated from Leadership Academy. COUNT 9: Respondent is in violation of State Board of Education Rule 6A- 6.03315, F.A.C., in that Respondent has provided false information to the Department on its SCF-1.
