Pimenta (“Respondent”) and alleges: ESSENTIAL ALLEGATIONS OF MATERIAL FACT 1. Petitioner is a state government licensing and regulatory agency charged with the responsibility and duty to prosecute Administrative Complaints pursuant to the laws of the State of Florida, in particular Section 20.165 and Chapters 120, 455 and 475, of the Florida Statutes and the rules promulgated pursuant thereto. 2. Respondent is and was at all times material hereto a licensed Florida real estate broker, issued license numbers H:\ac\pimenta.ac.doc FDBPR v. Hercules R. Pimenta Case No. 2009017733 Administrative Complaint 3207169, 3010560, 3225473, 3054578, 3064093, and 664987 in accordance with Chapter 475 of the Florida Statutes. 3. The last licenses issued were as an active broker at GZI Real Estate Sales & Marketing LLC, 11900 Biscayne Blvd. #290, Miami, Florida 33181; Elite International Realty Inc., 16139 Biscayne Blvd., North Miami Beach, Florida 33160; HRP Realty Services Inc., 16139 Biscayne Blvd., North Miami Beach, Florida 33160; Lotux Realty Inc., 1001 N. Federal Highway #324, Hallandale, Florida 33009; Suncity Realty Corp., 4454 NW 74° Avenue, Miami, Florida 33166; and at 16139 Biscayne Blvd., North Miami Beach, Florida 33160. 4. Respondent is the qualifying broker for Elite International Realty, Inc., a licensed real estate brokerage in the state of Florida. 5. Respondent knew or should have known that Sara Galvez is not now nor was at any time material herein, registered as a licensed real estate sales associate or broker in the state of Florida. 6. Respondent knew or should have known that Sara Galvez is the vice-president for Elite International Realty a licensed brokerage in the state of Florida. Pimenta Case No. 2009017733 Administrative Complaint Complaint Exhibit 1. 7. Respondent admits that Sara Galvez and Daniel Ickowicz are the owners of Elite International Realty. A copy of correspondence - is attached hereto and incorporated herein as Administrative Complaint Exhibit 2. 8. Respondent Knew or should have known that on or about July 24, 2009 Daniel Ickowicz resigned as an Officer/Director for Elite International Realty. A copy of correspondence is attached hereto and incorporated herein as Administrative Complaint Exhibit 3. 9. Respondent knew or should have known that on or about August 24, 2009 Sara Galvez, vice-president for Elite International Realty published or caused to be published advertisement for the sale of real properties at Flamingo South Beach Condominiums. A copy of advertisement is attached hereto and incorporated herein as Administrative Complaint Exhibit 4. 10. Respondent knew or should have known that Sara Galvez vice-president for Elite International Realty operates a website known as Sara Galvez.com for the sale of real estate properties. A copy of the website is attached hereto and incorporated herein as Administrative Complaint Exhibit 5. 11. Respondent knew or should have known that Sara Galvez vice-president for Elite International Realty offered for sale in H:\ac\pimenta.ac.doc 3 FDBPR v. Hercules R. Pimenta Case No. 2009017733 Administrative Complaint her website known as Sara Galvez.com a property located at 2000 Island Aventura Blvd., Unit 2308, Aventura FL 33160 for $398,000. 12. Respondent knew or should have known that Sara Galvez vice-president for Elite International Realty offered for sale in her website known as Sara Galvez.com a property located at 2600 Island Aventura Blvd., Unit 402, Aventura FL 33160 for $750,000. 13. Respondent knew or should have known that Sara Galvez vice-president for Elite International Realty offered for sale in her website known as Sara Galvez.com a property located at 6000 Island Aventura Blvd., Unit 1701, Aventura FL 33160 for $1,990,000. 14. Respondent knew or should have known that Sara Galvez vice-president for Elite International Realty offered for sale in her website known as Sara Galvez.com a property located at 3300 NE 192 St., Unit 1401, Aventura FL 33180. 15. Respondent knew or should have known that in all cases filed pursuant to Chapter 475 Florida Statutes, when Sara Galvez has advertised real estate for sale, lease, or describing the property, the title to which is not in Sara Galvez, at the time advertised, it shall be a presumption that Sara Galvez was acting or attempting to act as a real estate broker. 16. Pimenta Case No. 2009017733 Administrative Complaint vice-president for Elite International Realty offered for sale in her website known as Sara Galvez.com real properties for sale with the intention that Respondent and Sara Galvez would receive compensation or valuable consideration, directly or indirectly, paid or promised, expressly or implied, for the transactions. 17. Neither Respondent nor Sara Galvez had title or any other interest in the properties advertised for sale. COUNT ONE Based upon the foregoing, Respondent is guilty of aiding, assisting, procuring, employing, or advising any unlicensed person or entity to practice a profession contrary to Chapter 455, 475 or the rules of the Petitioner in violation of Section 455.227(1) (j), Florida Statutes. WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged. The penalties which may be imposed for violation(s) of Chapter 475 of the Florida Statutes, depending upon the severity of the offense(s), include: revocation of the license or registration or permit; suspension of the license, registration or permit for a period not to exceed ten (10) years, imposition of an H:\ac\pimenta.ac.doc 5 FDBPR v.
