STATE OF FLORIDA &, CRIMINAL JUSTICE STANDARDS AND TRAINING QD ff COMMISSION 1D ag CRIMINAL JUSTICE STANDARDS AND TRAINING COMMISSION, ] p- 2400 p L Petitioner, vs. CASE NO. 28008 Kelvin Cooper, Respondent. / ADMINISTRATIVE COMPLAINT The Criminal Justice Standards and Training Commission, hereinafter referred to as the Commission, files this Administrative Complaint against the Respondent, Kelvin Cooper. The Commission seeks to impose disciplinary action upon the referenced individual based on the following allegations: 1. Respondent was certified by the Criminal Justice Standards and Training Commission on October 6, 2006, and was issued Law Enforcement Certificate Number 260821 and on September 12, 2007, was issued Instructor Certificate Number 269824 and on December 11, 1998, was issued Correctional Certificate Number 185160. 2. (a) On or about October 3, 2008, the Respondent, Kelvin Cooper, did unlawfully and willfully, maliciously, and repeatedly follow another person, to wit: Yvonia Payne, to wit: waited for Yvonia Payne to exit the movies, the following day followed her while she was driving her vehicle, followed her home and tried to block her in, and then followed her in his vehicle as she called the police. (b) On or about October 3, 2008, the Respondent, Kelvin Cooper, did unlawfully, wantonly or maliciously throw a missile, four inch folding knife, which would produce death or great bodily harm, at, within or into a vehicle, which was being used or occupied by Yvonia Payne. (c) On or about October 3, 2008, the Respondent, Kelvin Cooper, did unlawfully have or carry a firearm, in the presence of one or more persons and exhibited the same in a rude, carless, angry or threatening manner, not in necessary self-defense. (d) On vs abvut October 3, 2008, the Respondent, Kevin soper, did unlawfully commit a battery upon Yvonia Payne, by actually touching or striking her or intentionally causing bodily harm to Yvonia Payne against her will. 3. The actions of the Respondent did violate the provisions of Section 784.048, 790.19, 790.10, 784.03 or any lesser included offenses, Section 943.1395(7), Florida Statutes, and Rules 11B- 27.001 1(4)b, a, b, b and 11B-20.0012(2)(f), Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Law Enforcement, Instructor, and Correctional officer or Instructor in the State of Florida have good moral character and which gives rise to a disciplinary action against Respondent's certification. 4. This Administrative Complaint is issued pursuant to Sections 120.60, 943.12(3), and 943.1395(7), Florida Statutes.. Any proceedings concerning this Complaint shall be conducted pursuant to Sections 120.569 and 120.57, Florida Statutes, and Chapters 11B-20, 11B-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Kelvin Cooper is guilty of violating Sections 943,1395(7), and 943.13(7), Florida Statutes, and Rules 11B-27.0011(4)b, a, b, b and 11B-20.0012(2)(f), Florida Administrative Code. NOW, THEREFORE, the Florida Criminal Justice Standards and Training Commission hereby complains against Kelvin Cooper and alleges that an appropriate penalty, as provided in Section 943,1395(7), Florida Statutes, should be imposed for the reasons set forth above and in accordance with the Election of Rights form (to which is attached an Explanation of Rights form) attached hereto and incorporated herein.
