ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, THE SCHOOL BOARD OF BROWARD COUNTY, FLORIDA, through its Superintendent, JAMES F. NOTTER, and files this Administrative Complaint and states the following; I. JURISDICTIONAL BASIS 1. The Agency is The School Board of Broward County, Florida located at 600 Southeast Third Avenue, Fort Lauderdale, Broward County, Florida 33301. 2. The name of the Petitioner is James F. Notter, who is the Superintendent of Schools of Broward County, Florida, His address is 600 Southeast Third Avenue, Fort Lauderdale, Broward County, Florida 33301. 3. The Petitioner is statutorily obligated to recommend the placement of School Board personnel, and require compliance and observance by all personnel with all laws, rules and regulations. See §1012.27, Fla. Stat. ) 4. ‘The employee against whom termination is recommended, Respondent, Jeffrey Dacteroff, has been employed by The School Board of Broward County, Florida, since 2004 and is currently employed as a teacher at Pines Middle School, The last known address of the Respondent, is 3301 N.W. 86" Avenue, Coral Springs, FL 33065, 5. The legal basis for Mr. Docteroff’s termination is misconduct in office that has been Nov 4 2010 15:53 2010-11-04 15:49 >> 8509216847 P 8/9 deemed so serious as to impair his effectiveness within the school system and insubordination. See §1012,33(1)(a), (4)(c), (6)(b), Fla. Stat. See also Fla. Admin. Coder. 6B-1.001, 6B-1.006, 6B- 4,009. I, ADMINISTRATIVE CHARGES The Petitioner, James F. Notter, alleges as follows: 6. This recommendation for termination from employment is based on allegations of assault against Mr, Docteroff by a student. 7. Tn 2008, Mr. Docteroff was under investigation by the School Board’s Professional Standards & Special Investigative Unit following an incidentin which he was accused of assaulting a student and throwing him against the wall. 8. The Professional Standards Committee found no probable cause but did issue a letter of concern. 9 In 2009, Mr. Docteroff was again accused of assaulting a student in the cafeteria at Pines Middle School. 10. Anuituber of witnesses, including staff and students, provided statements during the investigation, and a videotape showed that Mr. Doctoroff did push and strike the student. 11. Based on the foregoing, the Petitioner hereby recommends that Mr. Docteroff be terminated from his employment with The School Board of Broward County, Florida. 12. Mr. Docteroff’s recent behavior warrants termination from his employment with The School Board of Broward County, Florida, pursuant to the Florida Statutes and Administrative Code regulations set forth above. 13. Inaccordance with Florida law and the applicable Collective Bargaining Agreement, this recommendation for termination must be reviewed, and approved by The School Board of Broward County, Florida, See §1012.33(6)(b), Fla.
