The DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, DIVISION OF HOTELS AND

RESTAURANTS, ("Petitioner"), iiles this Administrative Complaint against COCONUTS CUBAN CAFE, ("Respondent"), and says:

  1. Petitioner is the state agency cilarged with regulating the operation of public lodging esiablisilments and public iood service establisl1ments, pursuant to Section 20.165 and Chapter 509, Florida Ststutes.

  2. Respondent is, and has been at all times material hereto, licensed b)' or subject to the jurisdiction of the Division of Hotels and Restaurants. The respondent's business address of record is 972 W SR 434, LONGWOOD, FLORIDA 32750.The mailing address of record is COCONUTS CUBAN CAFE, at PO BOX 520085, LONGWOOD, FLORIDA 32752,

  3. Inspection of this establishment conducted pursuant to Sec. 509,032, Florida Statutes, revealed violations of the provisions of Chapter 509, Florida Statutes, and/ or the rules promulgated thereto governing . operation of the establishment. The violation(s) found and applicable law are described in Exhibit "A," at\ached hereto and incorporated herein by reference. Inspection documents ara attached as Exhibit "8", incorporated herein by reference.

    WHEREFORE, Petitioner respectfully requests entry oi an Order imposing one or more cf the following penalties: administrative fine Ml to exceed $1,000 per offense, suspension, revocation, or refusal of a license issued pursuant to !his Chapl r, and/or an)' other relief authorized by Chapter 509, Florida Statutes, or the rules promulgated thereto.

Copy(s) of the report(s) for the above referenced lnspection(s) are attached hereto and incorporated by reference as Exhibit B. ·


      * 1. 05-09-1 4-204.112 FC;: (A) IN A MECHANICALLY REFRIGERATED OR HOT FOOD STORAGE UNIT, THE SENSOR OF A TEMPERATURE MEASURING DEVICE SHALL BE LOCATED TO MEASURE THE AIR TEMPERATURE OR A SIMULATED PRODUCT TEMPERATURE IN THE WARMEST PART OF A MECHANICALLY REFRIGERATED UNIT AND IN THE COOLEST PART OF A HOT FOOD STORAGE UNIT.

      (B) EXCEPT AS SPECIFIED INPARAGRAPH (C) OF THIS SECTION, COLD OR HOT HOLDING

      EQUIPMENT USED FOR POTENTIALLY HAZARDOUS FOOD SHALL BE DESIGNED TO INCLUDE AND SHALL BE EQUIPPED WITH AT LEAST ONE INTEGRAL OR PERMANENTLY AFFIXED TEMPERATURE MEASURING DEVICE THAT IS LOCATED TO ALLOW EASY VIEWING OF THE DEVICE'S TEMPERATURE DISPLAY. (C) PARAGRAPH (6) OF THIS SECTION DOES NOT APPLY TO EQUIPMENT FOR WHICH THE PLACEMENT OF A TEMPERATURE MEASURING DEVICE IS NOT A PRACTICAL MEANS FOR

      • 2. 32-04-1 B-202.14 FC, B1C-1.004(2)(B) FAC;: PUBLIC BATHROOMS SHALL BE COMPLETELY ENCLOSED.AND SHALL HAVE TIGHT- FITTING, SELF CLOSING DOORS OR, IN BATHROOMS LOCATED OUTSIDE A PUBLIC FOOD SERVICE ESTABLISHMENT, HAVE ENTRANCES AND l;;XITS CONSTRUCTED IN SUCH A MANNER AS TO ENSURE PRIVACY OF OCCUPANTS. SUCH DOORS SHALL NOT BE LEFT OPEN EXCEPT DURING CLEANING.QR MAINTENANCE EXCEPT THAT THIS [ENCLOSURE] REQUIREMENT DOES NOT APPLY TO A TOILET ROOM THAT IS LOCATED OUTSIDE, A FOOD ESTABLISHMENT AND DOES NOT OPEN DIRECTLY INTO THE FOOD ESTABLISHMENT SUCH AS A TOILET ROOM THAT IS PROVIDED BY THE MANAGEMENT OF A SHOPPING MALL.

  4. 38-10-1 61C-1.004(6) FAC:: (6) ALL BUILDING STRUCTURAL COMPONENTS, ATTACHMENTS AND FIXTURES SHALL BE KEPT IN GOOD REPAIR, CLEAN AND FREE OF OBSTRUCTIONS.


THE LIGHT IN THE WALK IN FREEZER WAS NOT FUNCTIONING.


5, 42-11-1 6--501.114 FC:: MAINTAINING PREMISES, UNNECESSARY ITEMS AND LITTER. THE PREMISES SHALL BE FREE OF: (A) ITEMS THAT ARE UNNECESSARY TO THE OPERATION OR MAINTENANCE OF THE ESTABLISHMENT SUCH AS EQUIPMENT THAT IS NONFUNCTIONAL OR NO LONGER USED; AND (B) LITTER.


THERE WERE UNNECESSARY ITl::MS ON THE PREMISES (PAINT, HOSES, ETC.)


* 6. 538-06-1 509,049 FS: FOOD SERVICE EMPLOYEE TRAINING. THE DIVISION SHALL ADOPT, BY RULE, MINIMUM FOOD SAFETY PROTECTION STANDARDS FOR THE TRAINING OF ALL FOOD SERVICE EMPLOYEES WHO ARE RESPONSIBLE FOR THE STORAGE; PREPARATION, DISPLAY, OR SERVING OF FOODS TO THE PUBLIC IN ESTABLISHMENTS REGULATED UNDER THIS CHAPTER. THESE STANDARDS SHALL NOT INCLUDE AN EXAMINATION, BUT SHALL PROVIDE f'OR A FOOD SAFETY TRAINING CE:RilFICATE PROGRAM FOR FOOD SERVICE EMPLOYEES TO BE ADMINISTERED BY A PRIVATE NONPROFIT PROVIDER CHOSEN BY THE DIVISION. ANY FOOD SAFETY TRAINING PROGRAM ESTABLISHED AND ADMINISTERED TO FOOD HANDLER EMPLOYEES PRIOR iO THE EFFECilVE DATE OF THIS ACT SHALL BE SUBMITTED BY THE OPERATOR TO THE DIVISION FOR ITS REVIEW AND APPROVAL.
