ADMINISTRATIVE COMPLAINT
Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL
REGULATION, ("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against JOHN PAUL GEORGE, ("Respondent"), and says:
Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 489, Florida Statutes.
Respondent is, and has been at all times material hereto, a Certified Building Contractor and a Certified Pool/Spa Contractor in the State of Florida, having been issued license numbers CB C031861 and CP C1456914, which are in "current, active" statuses.
Respondent's last known address of record is 4061 Royal Palm Beach Blvd, Royal Palm Beach, Florida 33411.
At all times material hereto, Respondent was doing business as JPG Enterprises, Inc. ("JPG Enterprises, Inc."), which is a qualified business entity in the State of Florida having been issued license number QB 36279 which is at present time in a "current" status.
Section 489.1195(1)(a), Florida Statutes, provides that all primary qualifying agents for a business organization are jointly and equally responsible for supervision of all operations of the business organization; for all field work at all sites; and for financial matters, both for the organization in general and for each specific job.
On or about January 20, 2009 the City of North Port Contractors Licensing and Advisory Board ("CNPCLAB") filed a complaint against Respondent alleging Respondent violated the City of North Port's Code 14-66, Standards of Conduct for State Certified Contractors, Section 1 and 4.
On or about April 14, 2009 the CNPCLAB held a hearing
and found Respondent guilty of fraud and failure to provide proof of insurance in violation of building code Section 14-64, Standards of conduct, City of North Port Code.
The CNPCLAB permanently revoked Respondent's
permitting privileges within the City of North Port.
Based on the foregoing, Respondent violated section 4 89 .129 ( 1) (h) , Florida Statutes, by being disciplined by any municipality or county for an act or violation of this part.
WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penal ties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $10,000 per violation, require continuing education,
assess costs associated with investigation and prosecution,
impose any or all penalties delineated within Section
455.227 (2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder.
