Attached is a complaint regarding Aaron Perfetto, who I am charging with failure to meet academic standards during employment with the School Board of Orange County, Florida.
Attached you will find a copy of those charges. Pursuant to Florida Statutes 1012.33 and 1012.34, if the School Board accepts my recommendation, the employee has the right to request an administrative hearing within 15 calendar days of your action. If no request for hearing is received within the time limit, the termination of the teacher's contract is final. During the 15 calendar day period referenced above, the teacher will be placed on suspension without pay in accordance with the negotiated agreement between the Classroom Teachers Association and Florida law. I am also recommending that you approve John C. Palmerini to act as my representative in this matter.
Please recall that we routinely refer these matters to the Division of Administrative Hearings if a hearing is requested by the teacher.
RECOMMENDED RESOLUTION:
I move that Aaron Perfetto be suspended without pay and terminated 15 days from recerpt of the attached charges if no hearing is requested. I further move that John C. Palmerini, Esq. be appointed to represent the Superintendent in this matter.

ADMINISTRATIVE COMPLAINT
RONALD BLOCKER, as Superintendent of Schools, for and on behalf of the School Board of Orange County, Florida, (hereinafter referred to as "Petitioner"), files this Administrative Complaint against Aaron Perfetto (hereinafter referred to as "Respondent").
Petitioner seeks the severance of Respondent's professional service contract with Petitioner pursuant to Section 1012.33, Florida Statutes for incompetency and Section 1012.34, Florida Statutes.
The Petitioner alleges:
The Respondent, at all times material to this Complaint, was employed as a classroom teacher by the Petitioner, the School Board of Orange County, Florida.
The Respondent holds a Professional Service Contract of employment
with the School Board of Orange County, Florida.
That on April 30, 2010, the Respondent received his 2009-2010 Final Assessment reflecting an overall Unsatisfactory (U) rating with ratings of "U" in Classroom Management and Discipline, Planning and Delivering Instruction and Professional Responsibilities. Respondent received Needs Improvement (NI) ratings in Curriculum Knowledge and Assessment of Student Performance and Individual Professional Development Plan. Attached hereto and incorporated herein as Attachment A is a copy of the 2009-2010 Final Assessment.
That on December 6, 2010, the Respondent was issued a 90-day Probationary Performance notice by the Principal. Attached hereto and incorporated herein as Attachment B is a copy of the 90-day notice to the Respondent and a Professional Improvement Plan addressing Classroom management and Discipline, Planning and Delivering Instruction, Curriculum Knowledge, and Professional Responsibilities.
That on March 23, 2011, the Respondent received his 2010-2011 Final Assessment reflecting an overall Unsatisfactory (U) rating. Attached hereto and incorporated herein as Attachment C is a copy of the 2010- 2011 Final Assessment.
That on April 4, 2011, the Respondent's 90-day Probationary Plan ended and Respondent was provided a seven (7) day notice of the final evaluation meeting. Attached hereto and incorporated herein as Attachment D is a copy of the meeting summary.
That on April 12, 2011, the Principal met with the Respondent and reviewed the 90-day Probationary Performance Plan results and shared with the Respondent that he had not made adequate improvement and issued him a letter reflecting such results. Attached hereto and incorporated herein as Attachment E is a copy of the notification letter, final meeting summary noting areas of incompetency and student performance data, and completed improvement plan.
That on April 18, 2011, the Area Superintendent forwarded her recommendation to terminate the Respondent for failure to show
adequate improvement. Attached hereto and incorporated herein as Attachment F is a copy of the 90-day Rule Recommendation.
Such actions by the Respondent, Aaron Perfetto, are in violation of School Board Policies and the Superintendent's Instructional Goals, demonstrates incompetence and constitutes willful neglect of duty, and a breach of Respondent's employment agreement with the School Boar
Said violations are sufficient grounds to sever the professional service contract with Respondent for incompetence.
THEREFORE, the Superintendent of Schools for the School Board of Orange County, Florida, recommends that the Board sever its professional service contract relationship with the Respondent and terminate immediately the employment of Respondent, Aaron Perfetto, and authorize John C. Palmerini to act as counsel in this
matter.

90-DAY NOTICE TO TEACHER

Dear Mr. Perfetto:
Pursuant to Section 1012.34 Florida Statues, you are being placed
on a ninety (90) calendar day peiformance probationary period (excluding school holidays and school vacation days), effeGtive from receipt of the notice of unsatisfactory peiformance to demonstrate corrective action, which notice has been served upon you tbis December 6, 2010.
You are hereby notified of the following Florida Statute 1012.34, procedural requirements.
Upon delivery of a notice of unsatisfactory performance, the evaluator must confer with the employee, make recommendations with respect to specific areas of unsatisfactory performance, and provide assistance in helping to correct deficiencies within a prescribed period of time.
The employee shall be placed on performance probation and governed by the provisions of this section for 90 calendar days from the receipt of the notice of unsatisfactory performance to demonstrate corrective action. School holidays and school vacation periods are not counted when calculating th'< 90-calendar day period. During the 90 calendar days, the employee must be evaluated periodically and apprised of progress achieved .and must be provided assistance and in service training opportunities to help correct the noted performance deficiencies_ At any time during the 90 calendar days, the employee may request a transfer to anot!ier appropriate position with a different supervising administrator; however, a transfer does not extend the period for correctiog performance deficiencies.
Within 14 days after the close of the 90 calendar days, the evaluator must assess whether the performance deficiencies have been corrected and forward a

recommendation to the superintendent. Within 14 days after rece1vmg the evaluator's recommendation, the superintendent must notify the employee in writing whether the performance deficiencies have been satisfactorily corrected and whether the superintendent will recommend that the school board continue or terminate his or her employment contract. If the employee wishes to contest the superintendent's recommendation, The employee must, within 15 days after receipt of the superintendent's recommendation, submit a written request for a hearing. Such a hearing shall be conducted at the school board's election in accordance with one of the following procedures:
A direct hearing conducted by the school board within 60 days after receipt of the written appeal. The hearing shall be conducted in accordance with the provisions of ss.120.569 and 120.57. A majority vote of the membership of the school board shall be required to sustain the superintendent's recommendation. The determination of the school board shall be final as to the sufficiency or insufficiency of the grounds for termination of employment; or
A hearing conducted by an administrative jaw judge assigned by the Division of Administrative Hearings of the Department of Management Services. The hearing shall be conducted within 60 days after receipt of the written appeal in accordance with Chapter 120. The recommendation of the administrative law judge shall be made to the school board. A majority vote of the membership of the school board shall be required to sustain or change the administrative law judge's recommendation. The determination of the school board shall be final as to the sufficiency or insufficiency of the grounds for termination of employment.
The superintendent shall notify the department of any instructional personnel who receives two consecutive unsatisfactory evaluations and who have been given written notice by the district that their employment is being terminated or is not being renewed or that the school board intends to terminate, or not renew, their employment. The department shall conduct ail investigation to determine whether action shall be taken against the certificate holder pursuant to S. 1012.795 (1) (b).
The superintendent shall develop a mechanism for evaluating the effective use of assessment criteria and evaluation procedures by administrators who are assigned responsibility for evaluating the performance of instructional personnel. The use of the assessment and evaluation procedures shall be considered as part of the annual assessment of the administrator's performance. The system must include a mechanism to give parents and teachers an opportunity to provide input into the administrator's performance assessment, when appropriate.
Nothing in this section shall be construed to grant a probationary employee a right to continued employment beyond the term ofhis or her contract
The district school board shall establish a procedure annually reviewing

instructional personnel assessment systems to determine compliance with this section. All substantial revisions to an approved system must be reviewed and approved by the school board before being used to assess :instructional personnel. Upon request by a school district, the department shall provide assistance in developing, improving, or reviewing an assessment.
The attached Professional Improvement Plan and F.P.M.S. observation/assessment forms document the unsatisfactory performance/performance deficiencies. During your -ninety (90) calendar day probation period, you will be evaluated periodically and apprised of progress achieved and you will be provided assistance to help correct the noted performance deficiencies.
Failure to correct the performance deficiencies may result in a reco=endation to terminate your employment contract with the School Board of Orange County, Florida

As documented In his FPMS observations as well as informal observations, Mr. Perfettof ill have some students move stars for behaviors and other students do not have to for he · same behaviors. RE: AARON PERFETTQ_
Please be advised that I have received a recommendation from Ms.
Wendy Ivory.of John Young Elementary School, to dismiss Aaron Perfetto under the provisions of Florida Statute 1012.34. I have reviewed the complete documentation package as provided by this principal. In addition, I have reviewed with Employee Relations the technical aspects of this case. It is my recommendation that Aaron'Perfetto be dismissed.
This teacher completed a 90-day performance probation period on April 4, 2011, and his performance was assessed on April12, 2011. To be in conformance with the 90-day rule, the superintendent.must notify the teacher of an unsatisfactory assessment and make a recommendation to terminate, in writing, no later than fourteen (14) days from receipt of this letter.
