ADMINISTRATIVE COMPLAINT


COMES NOW the Petitioner, the Florida Department of Health (hereinafter Depaiiment), Hernando County Health Department (hereinafter HCHD), by and through the undersigned attorney, files this Administrative Complaint pursuant to section 381.0065, Fla. Stat. (2010), and the Fla. Admin. Code. R. 64Ew6, and alleges the following:

  1. The Depaiiment, by and through its employees, is duly authorized by section 381.0011(4), Fla. Stat. (2010), to "administer and enforce laws and rules relating to sanitation, control of communicable diseases, illnesses and hazards to health among humans and from animals to humans, and the general health of the people of the state.''

  2. The Depaiiment is authorized by section 381.0012(1), Fla. Stat. (2010), to commence and maintain all necessary actions and proceedings to enforce the rules adopted pursuant to this chapter.

  3. The Department is required to conduct an environmental health program as part of fulfilling the State's public health mission. The purpose of this program is to detect and prevent disease caused by natural and manmade factors in the environment. Section 381.006, Fla. Stat. (2010).

  4. The Department is required to perform application reviews and site evaluations, issue pe1mits, and conduct inspections and complaint investigations associated with the construction, installation, maintenance, modification, abandonment, operation, use, or repair of an onsite

    sewage treatment and disposal system for a residence or establislnnent. Section 381.0065(3)(b), Fla. Stat. (2010).

  5. The Depaiiment issues a registration, and regulates, any and all Florida septic tank contractors pursuant to section 489.553(2), Fla. Stat. (2010), which provides:

    (2) "The department shall administer, coordinate, and enforce the provisions of this part, provide qualifications for applicants, administer the examination for applicants, and be responsible for the granting of certificates ofregistration to qualified persons."


    FACTS

  6. The Respondent is a natural person, resides in the State of Florida, and is registered and authorized by the Department, section 489.553, Fla. Stat. (2010), to provide septic tank contracting services as a septic tank contractor, registration number SR0061541. As a registered septic tank contractor, Respondent is subject to Fla. Admin Code R. 64E-6.022, Standards of Practice and Disciplinary Guidelines.

  7. Johns by Johns II, Inc. (SA004l 171) is a Florida corporation, doing business in Hernando County, Florida, and is owned and operated by the Respondent. The Corporation's address of record filed with the Department is 11192 Archer Avenue, Spring Hill, Florida 34608. Johns by Johns II, Inc. has been authorized by the Depa1iment to practice septic tank contracting services under the direction of its qualifier, the Respondent.


    14491 Coronado Drive, Spring Hill, Florida 34609

  8. On November 3, 2010, Mr. William Schreiber contracted with Respondent to pump the septic tank at his home at 14491 Coronado Drive, Spring Hill,

    Florida 34609. (Exhibit A)

  9. On November 5, 2010, Mr. William Schreiber wrote a formal complaint to Respondent indicating an overcharge for services, and unprofessional conduct. (Exhibit B)

  10. On November 11, 2010, Mr. William Schreiber hired a second company to pump the septic tank due to the continued system failure. (Exhibit C)

  11. On November 17, 2010, the Department received a complaint from Mr. William Schreiber regarding the services rendered by the Respondent. (Exhibit D)



  12. A Department inspector conducted an inspection of Mr. William Schreiber 's property and the service rendered by Respondent on November 18, 2010, and found the following violations:

    1. The Respondent failed to pump the tank through the lid/manhole as required by Fla. Admin. Code R. 64E-6.010(4)(b). The Respondent instead pumped the tank through a 5" hole on top of the tank. Fla. Admin. Code R. 64E-6.010(4)(b) provides:

      (4)(b) "The access to pump a tank must be through the lid of the tank, through the manhole or by moving a sectional lid. Where the tank is chambered, separate chambers must be accessed through the manholes or sectional lid for the chamber being pumped. Pumping shall not be accomplished by entering the tank through inlets or outlets. Where the lid of the tank must be broken in order to gain access for the removal of tank contents, or at anytime when the lid is broken, the lid shall be replaced.11


    2. The Respondent failed to replace and seal the damaged lid as required by Fla. Admin. Code R. 64E-6.010(4). Respondent placed an irregular piece of concrete on top of the damaged lid. Fla. Admin. Code R. 64E-6.010(4), provides:

      (4) "After septage or food establishment sludge is removed from an onsite sewage treatment and disposal system, the original lid of the tank shall be put back in place, or be replaced with a new lid if the original lid is broken. The tank lid shall be completely sealed and secured as per paragraph Fla. Admin. Code R. 64E-6.013(2)(i), and the ground backfilled and compacted so that the site is left in a nuisance free condition."


    3. The Respondent failed to pump the tank in its entirety as required by Fla. Admin. Code R. 64E-6.010(4)(a). On November 11, 2011, a second contractor found that the tank was not pumped in its entirety leaving approximately 2 feet of solid waste/sludge.

      Fla. Admin. Code R. 64E-6.010(4)(a) provides:

      1. "Contents of any treatment tank, including all chambers of a multi­ chambered tank, or pump tank shall be removed in their entirety when pumped. Where in the opinion of the person pumping any onsite sewage treatment and disposal system waste receptacle or pump tank, the complete removal of all tank contents may create an unintended problem in regards to the continued use of the system, a complete pump-out is not required. The pumper must document, in writing, to the system owner the reason for the



        partial pump-out, the gallonage pumped from the system, and what material was left in the tank."


        7428 River Country Drive, Weeki Wachee, Florida 34607

  13. On January 20, 2011, Ms. Filomena M01rnngiello contracted with the Respondent to pump the septic tank at his home at 7428 River Country Drive, Weeki Wachee, Florida.

  14. On January 20, 2011, Ms. Filomena Mo1Tongiello called Respondent and requested him to return to the property to complete the work as the tank was not emptied in its entirety. Ms. Filomena Monongiello reported that the Respondent refused to complete the work. (See Exhibit F)

  15. On January 26, 2010, a Department inspector conducted an inspection of Ms Filomena Morrongiello's property, and the service rendered by Respondent, and found the following violations:

    1. The Respondent failed to pump the tank in its entirety as required by Fla. Admin. Code R. 64E-6.010(4)(a), leaving approximately 8" of solids waste/sludge.

      Fla. Admin. Code R. 64E-6.010(4)(a), provides:

      1. "Contents of any treatment tank, including all chambers of a multichambered tank, or pump tank shall be removed in their entirety when pumped. Where in the opinion of the person pumping any onsite sewage treatment and disposal system waste receptacle or pump tank, the complete removal of all tank contents may create an unintended problem in regards to the continued use of the system, a complete pumpout is not required. The pumper must document, in writing, to the system owner the reason for the partial pumpout, the gallonage pumped from the system, and what material was left in the tank."


  16. On January 27, 2011, the Ms. Filomena Monongiello submitted a written formal complaint with the Depaiiment outlining the said grievances in paragraph (II)(b) above.

    12452 Groveland Street, Spring Hill, Florida 34609

  17. On January 24, 2011, Mr. Scln·amon contracted with the Respondent to pump the septic tank at the home at 12452 Groveland Street, Spring Hill, Florida. (Exhibit G)



  18. On January 26, 2010, a Department inspector conducted an inspection of 12452 Groveland Street, Spring Hill, Florida, owned by Ms. Gwen Gore, and the service rendered by Respondent, and found the following violations:

    1. The Respondent failed to pump the tank in its entirety as required by Fla. Admin. Code R. 64E-6.010(4)(a), leaving approximately 10" of solids waste/sludge. Fla. Admin. Code R. 64E-6.010(4)(a), provides:

      1. "Contents of any treatment tank, including all chambers of a multichambered tank, or pump tank shall be removed in their entirety when pumped. Where in the opinion of the person pumping any onsite sewage treatment and disposal system waste receptacle or pump tank, the complete removal of all tank contents may create an unintended problem in regards to the continued use of the system, a complete pumpout is not required. The pumper must document, in writing, to the system owner the reason for the partial pumpout, the gallonage pumped from the system, and what material was left in the tank."



  19. The above sited violations are evidence of gross negligence, incompetence and misconduct, a violation of the Fla. Admin. Code R. 64E-6.022(1)(1).

    (I) Gross negligence, incompetence, or misconduct which:

    1. "Causes no monetary or other harm to a customer, or physical harm to any person. First violation, letter of warning or fine up to $500; repeat violation,

    $500 fine and 90 day suspension or revocation."


  20. The Respondent has been repeatedly disciplined by the Depa1iment for violations of the standards governing registered septic tank contractors in the State of Florida. Respondent has paid fines totaling $1,000.00 and five (5) written apologies for previous violations (Exhibit H), including payment of fines for misconduct of the same type as alleged in this administrative complaint:

    1. SCl072: On March 29, 2006, Respondent misrepresented himself as a registered septic tank contractor in front of a customer and a representative of the Bureau of Onsite Sewage Programs violating section 486.552 Fla. Stat. (2010). Respondent paid a fine, and provided a written apology, via the Settlement Agreement dated January 24, 2007.


    2. SC1106: On April 6, 2006, Respondent received a Department citation sighting Fla. Admin. Code R. 64E-6,010(4) and 64E-6.010(4)(b), alleging that Respondent did not seal the septic tank manhole lid after pumping, and broke the lid by poking two holes with a heavy crow bar. Respondent paid a fine, and provided a written apology, via the Settlement Agreement dated January 24, 2007.

    3. SC1107: On April 16, 2006, Respondent received a Department citation sighting Fla. Admin, Code R. 64E-6,022(1 )(k), alleging that Respondent practiced fraud/deceit in that he contracted to install a 444sq.ft. drain field and installed a 324sq.ft. drain field without notifying the owner of the change. Inspection of the drain field revealed that the property had enough room for the contracted 444sq.ft. system. Respondent paid a fine, and provided a written apology, via the Settlement Agreement dated January 24, 2007.

    d, SC1108: On May 5, 2006, a complaint was filed with the Department against Respondent alleging incompetence, fraud, and deceit, a violation of Fla. Admin. Code R. 64E- 6,022(1)(k). Respondent failed inspection five times and gave incorrect information to the owner, knowing it was false. Respondent paid a fine, and provided a written apology, via the Settlement Agreement dated January 24, 2007,

    1. SCI 105: On June 26, 2006, a complaint was filed with the Department against Respondent alleging gross negligence, causing monetary and other hatm, which was a violation of Fla. Admin. Code R. 64E-6,022(1)(1)(2). When in the process of repairing an onsite sewage treatment and disposal system, Respondent ran the backhoe onto the complainant's single family residence, causing extensive damage to the structure. Respondent failed to arrange for the damages to be corrected. Respondent paid a fine, and provided a written apology, via the Settlement Agreement dated January 24, 2007,

    2. SC1032: On July 22, 2005, Respondent received a Department citation imposing a fine, sighting Fla. Admin. Code R. 64E-6.022(1)(1)(1) and 64E-6.022(1)(p), alleging that Respondent knowingly used spoil material laden with organic matter from the original drain field as cover for the new drain field. (Exhibit I) After four failed inspections, Respondent still did not comply with specifications in Fla. Admin, Code R.64E-6. On August 7, 2006, a Settlement Agreement was signed and the onsite sewage treatment and



      disposal system contractor, Sherri Ritter, voluntarily relinquished her certificate of registration.

    3. On August 7, 2006, the Department sent Respondent a letter indicating that engaging in the practice of septic tank contracting was not permitted until a valid onsite sewage treatment and disposal system contractor's registration was obtained, and that such was a violation of Fla. Admin. Code R. 64E-6.022(1)(a). (Exhibit J)

    4. On June 18, 2007, the Department sent Respondent a Stop Sale and Use Notice. Respondent was selling a bacterial additive that was not registered for sale in the State of Florida, which is a violation of Fla. Admin. Code R. 64E-6.0151(2). (Exhibit K)


    ARGUMENT


  21. The above-described actions of Respondent constitute violations of the standards of practice and disciplinary guidelines governing registered septic tank contractors in the State of Florida. Fla. Admin. Code R. 64E-6.022.

  22. Fla. Admin. Code R. 64E-6.022(3), provides that a septic tank contractor's previous disciplinary record shall be taken into account when determining the level of penalty:

    (3) "As used in this rule, a repeat violation is any violation on which disciplinary action is being taken where the same licensee had previously had disciplinary action taken against him or received a letter of warning in a prior case. This definition applies regardless of the chronological relationship of the violations and regardless of whether the violations are of the same or different subsections of this rule. The penalty given in the above list for repeat violations is intended to apply only to situations where the repeat violation is of a different subsection of this rule than the first violation. Where the repeat violation is the very same type of violation as the first violation, the penalty set out above will generally be increased over what is shown for repeat violations."


  23. In addition, Fla. Admin. Code R. 64E-6.022(2), provides the Department with the authority for "aggravation of penalty'' in a disciplinary action against a septic tank contractor, specifically:

    1. Circumstances which shall be considered for the purposes of mitigation or aggravation of penalty shall include the following:

      1. Monetary or other damage to the registrant's customer, in any way associated with the violation, which damage the registrant has not relieved, as of the time the penalty is to be assessed.



      2. Actual job-site violations of this rule or conditions exhibiting gross negligence, incompetence or misconduct by the contractor, which have not been corrected as of the time the penalty is being assessed.

      3. The severity of the offense.

      4. The danger to the public.

      5. The number ofrepetitions of the offense.

      6. The number of complaints filed against the contractor.

      7. The length of time the contractor has practiced and registration category.

      8. The actual damage, physical or otherwise, to the customer.

      9. The effect of the penalty upon the contractor's livelihood.

    G) Any efforts at rehabilitation.

    (k) Any other mitigating or aggravating circumstances.


  24. Based upon circumstances of the three incidents, aggravation of penalty to the maximum penalty allowed under Florida Law, revocation of Respondent's registration to practice septic tank contracting, and imposition of a substantial fine in the amount of $3,000.00, is just and wa1rnnted. Respondent has flaunted every single circumstances that would demand aggravation of the penalties allowed to the most severe allowed under Department rules.


    CONCLUSION

  25. The facts and law are grounds upon which a revocation of Respondent's registration to practice septic tank contracting is warranted. Furthermore, Respondent's disdain for his professional standards of conduct, and receipt of citations for violations, demand further imposition of a fine in the amount of $3,000.00.

I am letting you know that I will be submitting a formal complaint to the BBB. On 3 November I requested that my septic tank be pumped out because of a backup of the system. I had my plumber on site who had already run snakes through the system, dugout and found the clean out plug and realized the system was not working but backing up into the house.


Your man finally got here at 3PM, after telling me he was going to have lunch at 12:10 PM, I'd say that was a ratherfong lunch. Eventually the tank was pumped, you man indicating that I n.eeded a new leach field He said he would do it for $1500.00. I went inside and discussed this with my plumber, and decided to hold off for the tune being. Upon notifying your man about this, he went into a tirade, belittling my plumber saying he couldn't do it and any number of other. unsavoty things about another contractor to my utter shock. Never in my 74 years have I heard such debasement about another contractor, nor the complete

lack of professionalism and courtesy of your man. Your man is ce1tainly not a good advertisment for your business, furthermore, I have learned that he confronted my contractorin the parking lot of a local restaurant. Back inmy day we bad a word for this kind of person, yet will defer on the side of decency.


When he left, he presented me with a bill for$ 275.00, which I believe is a ripoff and had taken this 74n year old for a ride. Needless to say I run not happy. And today, I find that you price for a pump is$ 135.00


You can be assured that your services will never be used again and I will tell all who would listen and ask me for a recommendation, defmitely not use John by John .II, for anything.


I have included a copy of the bill for your use as you deem necessa1y. I do expect a refund of$ 140.00, which is twice as much as you charge other customers..


A copy of this letter will be forwarded to the BBB.

Your product is not allowed to remain for sale and use in Florida upon receipt of this letter. You are advised that continued sale and use of the product may result in fines of $500 for each violation per day as referenced In s 381.0061, F.S


Facts: On June 15, 2007 the department received a copy of a receipt dated 3/30/2006 and product sample of a bacterial additive •Johns By John ii" sold tq a consumer in Spring Hill, Florida This product has not been evaluated and is not allowed for use In Florida

Conclusion: Section 381.0065(4)(m), Florida Statutes, requires review of product contents because
