RESTAURANTS, ("PetItroner"), files this Adminrstrative Complaint against XPERT ELEVATOR SERVICES,INC., ("Respondent"}, and says,

1. PetrtIoner 1s the state agency charged with regulating the operat1on, rnstallatron, maintenance, and inspection of elevators, pursuant to Section 20 165 and Chapter 399, Flonda Statutes

2. Respondent Is, and has been at all times material hereto, subJect to the 1unsdIctIon of the D1v1s1on of Hotels anti Restaurants The respondent's business address of record Is 17119 43RD ROAD NORTH, LOXAHATCHEE, FLORIDA 33470 The marling address of record rs XPERT ELEVATOR SERVICES.INC at 17119 43RD ROAD NORTH, LOXAHATCHEE, FLORIDA 33470

Inspection of the elevator conducted pursuant to Sec 399.061(1)(a}, Florida Statutes, revealed vIolat1ons of the provIsIons of Chai:>ter 399, Florida Statutes, and/ or the rules promulgated thereto governing operation of the establishment The v1olatIon(s) found an applicable law are descnbed In ExhIbIt "A," attached hereto and incorporated herein by reference Inspection documents are attached as ExhIb1t "B", incorporated herein by reference

WHEREFORE, Petitioner respectfully requests entry of an Order imposing one or more of the following penalties admrnIstrat1ve fine not to exceed $1,000 per offense, ws.pensIon, revocation, and/or any other relief authorized by Sec 399 049, Flonda Statutes, or the rules pro u aa\ed thereto

1 399 03(1) FS A conveyance covered by this chapter may not be erected, constructed, installed, or altered within bu1le1ngs or structures until a permit has b.een obtained from the department A copy of the permit and plans must be kept at the construction site at all·times the work 1s 1n progress ·

On or before May 11, 2009, Respondent commenced an alteration of elevator license number 20173 without having obtained a permit to alter from the department
