Respondent ADMINISTRATIVE COMPLAINT COMES NOW, the Petitioner, Pinellas County Construction Licensing Board, hereinafter referred to as "Petitioner," and files this Administrative Complaint against RAUL FERNANDEZ JR., hereinafter referred to as “Respondent,” and alleges: 1. Petitioner seeks to suspend, revoke or take other disciplinary action against the Respondent as licensee and against his license to practice contracting pursuant to Chapter 75-489, Laws of Florida, as amended. 2. Respondent is a Certified General Contractor having been issued license |- CGC1514973 (CGC1514973). Respondent's last known address is 10950 NW 138" Street, Suite #6, Hialeah, FL 33018. 3. At all times material Respondent was the qualifying contractor for Caribbean Building Corp. COUNT ONE 4. On or about December 20, 2011, PCCLB Investigator Wiseman responded to a report by the Largo Building Department of unpermitted work underway at 1775 South Highland Avenue, Largo, FL. 5. Investigator Wiseman met with the Largo Building Department on site and found a demo permit however the Building Department stated the work underway exceeded that allowed on the demo permit. 6. COUNT TWO 7. Paragraphs 1 through 6 restated as if in full. 8. Respondent failed to obtain inspection of the work as required in violation of Section 105, Florida Building Code 2007 - Building; Section 489.129 (1)(0), Florida Statutes and Section 24(2)(n), Chapter 75-489, Laws of Florida, as amended. COUNT THREE 9. Paragraphs 1 through 8 restated as if in full. 10. Respondent failed to register Respondent's license, number I-CGC 1514973, which made Respondent's license inoperative and therefore unlawful for Respondent to engage in contracting in violation of Section 489.127 (1}(a)(b)(e)(f)(i), Florida Statutes; and Section 20(3), Chapter 75-489, Laws of Florida, as amended. COUNT FOUR 11, Paragraphs 1 through 10 restated as if in full. 12. Respondent committed misconduct in the practice of contracting in violation of Section 489.129 (1)(m), Florida Statutes, and Section 24 (2)(m), Chapter 75-489, Laws of Florida, as amended. Based on the foregoing, Respondent violated Sections 104 and 105, Florida Building Code 2007 - Building; Section 489.127 (1)(a)(b\(e(f\(h)(i), Florida Statutes; Section 489.129 (1)(0), Florida Statutes; and Section 20(3), Chapter 75-489, Laws of Florida, as amended; Section 24(2)(d)(j(m)(n), Chapter 75-489, Laws of Florida, as amended; and Pinellas County Code, Section 22-14.
