CASE NO. 2009-16320 JULIO PRADO, P.A., RESPONDENT. / ADMINISTRATIVE COMPLAINT COMES NOW, Petitioner, Department of Health, by and through its undersigned counsel, and files this Administrative Complaint before the Board of Medicine against Respondent, Julio Prado, P.A., and in support thereof alleges: 1. Petitioner is the state department charged with regulating the practice of physician assistance pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 458, Florida Statutes. 2. At all times material to this Complaint, Respondent was a licensed physician assistant within the state of Florida, having been issued license number PA 9100232. Filed July 10, 2012 12:57 PM Division of Administrative Hearings 3. Respondent’s address of recordis 104 SW 180 Avenue, Pembroke Pines, Florida 33029. 4. At all times material to this Complaint, Respondent was not licensed to practice as a medical doctor in the state of Florida. 5. At all times material to this Complaint, Respondent was employed by the P.A.C Medical Center (PAC) located in Hialeah, Florida. 6. On or about January 20, 2005, Respondent examined patient LT during an evaluative office visit. 7. Respondent signed the evaluation form “Dr. Prado.” 8. On or about February 22, 2005, Respondent examined patient LT during another evaluative office visit. 9. Respondent again signed the evaluation form “Dr. Prado.” 10. A reasonably prudent Physician Assistant under similar conditions and circumstances would refer to himself as a physician assistant only. 11. Section 458.347(7)(g), Florida Statutes (2007), allows the Board to impose any of the penalties authorized under Sections 456.072 and 458.331(2), Florida Statutes, upon a physician assistant if the physician assistant has been found guiity of or is being investigated for any act that constitutes a violation of Chapter 458, Florida Statutes, or Chapter 456, Florida Statutes. 12. Section 456.072(1)(a), Florida Statues (2004), provides that making misleading, deceptive, or fraudulent representations in or related to the practice of the licensee's profession, constitutes grounds for disciplinary action. 13. Respondent made misleading, deceptive, or fraudulent representations in or related to the practice of his profession, in one or more of the following ways: a. _ By signing LT’s evaluation form as “Dr. Prado” on January 20, 2005; b. By signing LT’s evaluation form as “Dr. Prado” on February 22, 2005. 14. Based on the foregoing, Respondent violated Section 456.072(1)(a), Florida Statues (2004), by making misleading, deceptive, or fraudulent representations in or related to the practice of the licensee's profession. WHEREFORE, Petitioner respectfully requests that the Board of Medicine enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent's license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate.
