The DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, DIVISION OF HOTELS AND
RESTAURANTS, ("Petitioner’), files this Administrative Complaint against MASCO CONTRACTOR
SERVICES CENTRAL INC, ("Respondent’), and says:
1, Petitioner is the state agency charged with regulating the operation, installation, maintenance, and
inspection of elevators, pursuant to Section 20,185 and Chapter 399, Florida Statutes.
2. Respondent is, and has been at all times material hereto, subject to the jurisdiction of the Division of
Hotels and Restaurants. The respondent's business address of record is 2339 BEVILLE RD, DAYTONA
BEACH, FL. 32119, The mailing address of record is ATTN: LICENSING, 260 JUMMY ANN DR,
DAYTONA BEACH, FL 32144.
3. Investigation revealed violations of the provisions of Chapter 399, Florida Statutes, and for the rules
promulgated thereto governing the operation, installation, maintenance, and inspection of elevators. The
violation(s) found and applicable taw are desoribed in Exhibit “A’, attached hereto and incorporated by
reference. Inspection documents are attached as Exhibit "B’, incorporated herein by reference.
WHEREFORE, Petitioner respectfully requests entry of an Order Imposing one or more of the following
penalties: administrative fine not to exceed $1,000 per offense; suspension, revocation, and/or any other relief
authorized by Chapter 399, Florida Statutes, or the rules pramulgated thereto,

itis alleged thaton January 15, 2014, the Respanderit was in violation of Florida Statute 399 (FS) and/or the
Rules of the Division of Hotels and Restaurants, Bureau of Elevator Safety, Florida Administrative Code (FAC),
in the follawing particulars.
4, 399.064 (4) When the division determines that ah elevator is in violation of this chapter or the
Florida Building Code, the divisioh may issue an order to the elevator owner requiring
correction of the violation and re-inspection of the elevator evidencing the correction.
2. 399.105 (4) An elevator owner who fails to comply with an order to correct issued under 8.
399.061(4) within 80 days after its issuance is subject, in addition to any other penalty
provided by law, to an administrative fine in an amount not to exceed $1,000.
On October 7, 2013, the Respondent was operating elevator, license number 51 940,
located at Masco Contractor Services Central Inc, 2339 Beville Rd Daytona Beach, FL
32119, This elevator was inspected by State Inspector Robert J. Badke, During the
inspection there were seyen viclationg noted. The violations were annual test required;
fast recorded in 2007, relief valve not sealed, test jog not filled in, no code data tag in
place, fire extinguisher in machine room outdated, no.emergency evacuation procedures
and no phorie service in car.
On January 16, 2014, the Respondent was re-inspected by State Inspector Badke, The
violations found during the initial inspection had not been corrected,
