Petitioner is the state agency charged with supervising businesses licensed under the Florida beverage, tobacco and tax, and tobacco products permit laws pursuant to sections 559.061, 561,07, 561,15, 561.19, 561.29, 561.501, 210.15, 210.16, 210,45, 210.50, 569,003, and 569.006, Florida Statutes. 2, Respondent is, and has been at all times material hereto, the holder of a valid license/permit, issued in the State of Florida, by the Division of Alcoholic Beverages and Tobacco. Respondent's last known nailing address is as follows: JERMAINE HILL D/B/A CLUB DEJAVU 712 E. 13TH COURT PANAMA CITY, FL 32401 And the division has not been notified of any other designated person or address for the service of process and notices authorized by Rule 61A-2.012, Florida Administrative Code. 3. Petitioner intends to revoke; suspend; annul; impose civil penalties, investigative costs, and late penalties; or any combination of these authorized penalties. JERMAINE HILL D/B/A CLUB DEJAVU LICENSE NUMBER BEV1310885 You, JERMAINE HILL, D/B/A CLUB DEJAVU, are charged with the following count(s): 1. On or about April 27, 2012, December 1, 2012, and/or February 10, 2013, you, the aforementioned licensee, holding a license under the Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), did unlawfully on your licensed premises, allow or permit the sale, possession, or consumption of an illegal controlled substance, to wit: cannabis, this act being contrary to and in violation of section 893.13(4)(a), within 561.29(1}(a), Florida Statutes. 2. On or about December 1, 2012, and/or February 10, 2013, you, the aforementioned licensee, halding a license under the Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), did unlawfully on your licensed premises, sell alcoholic beverages, to wit: Hennessy mixed drink, in any manner not permitted or authorized under your license, to wit: in a “to go” manner by allowing Agent Reynolds to leave the licensed premises with the mixed drink, this act being contrary to and in violation of section 562,12(1), within 561,29(1)(a), Florida Statutes. $. On or about December 1, 2012, and/or February 10, 2013, you, the aforementioned licensee, holding a license under the Beverage Law, did fail to provide the required service area, seating, and equipment to serve 150 persons full course meals at tables at one time as required to qualify for your license, this act being contrary to and in violation of section 561.20(2)(a)4 and Florida Administrative Code 61A-3.0141, within 561.29(1)(a), Florida Statutes. 4. On or about November 1, 2012, thraugh December 31, 2012, you, the aforementioned licensee, holding a license under the Beverage Law, did fail to derive at least 51 percent of your gross revenue from sales of food and non-alcoholic beverages as required to qualify for your license, this act being contrary to ahd in violation of section $61.20(2)(a)4 and Florida-Administrative Code 61A- 3.0141, within 561.29(1)(a), Florida Statutes. §. On or about April 27, 2012, December 1, 2012, and February 10, 2013, you, the proprietor or, your person in charge, did fail to comply with a provision of the Florida Clean Indoor Air Act. You unlawtully allowed persons to smoke or possess a lighted tobacco product within an enclosed indoor workplace, Failure to comply with this provision of the Florida Clean Indoor Air Act is contrary to section, 386.204, within 386.207, Florida Statutes.
