Comes now, the Division of Alcoholic Beverages and Tobacco, herein after referred to as
* “petitioner,” and files this administrative complaint against $0 FAYA INC herein after referred to as,
“respondent,” and alleges:
1. Petitioner is the state agency charged with supervising businesses licensed under the
Florida beverage, tobacco and tax, and tobacco products permit laws pursuant to
sections 559.061, 561.07, 561.15, 561.19, 561.29, 561.501, 210.15, 210.16, 210.45,
210,50, 569.003, and 569.006, Florida Statutes.
2. Respondent is, and has been at all times material hereto, the holder of a valid
license/permit, issued in the State of Florida, by the Division of Alcoholic Beverages
and Tobacco. Respondent’s last known mailing address is as follows: :

You, SO FAYA INC, D/B/A 4M FOOD MART, are 5 charged with the folowing count(s):
1. On or about April 1, 2013, you, the aforementioned licensee, holding a license under the
‘Beverage Law, or your agent(s), officer(s),. servant(s), or employee(s), to wit: Bassam Abu-Diab and
Matthew Abu-Diab, did unlawfully on your licensed premises or elsewhere while in the scope of
employment, illegally traffic in U.S.D.A, Food Coupons / EBT benefits, in a manner not authorized by
Federal Law, to wit: paying EBT cardholders in cash for overcharged transactions and/or use of their
EBT card so as to purchase merchandise for the licensed premises and/or items for personal use,
this act being contrary to and in violation of section 414.39(3)(a), Florida Statutes, within
561.29(1)(a), Florida Statutes.
2. On or about December 10, 2012, you, the aforementioned licensee, holding a license under the
Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), did unlawfully on your
licensed premises, allow or permit a person, to wit: Bassam Abu-Diab to traffic in or endeavor to
traffic in property that was known or should have been known to be stolen, this act being contrary to
and in violation of section 812.019(1),Florida Statutes, within 561.29(1)(a), Florida Statutes.
3. On or about December 19, 2012, you, the aforementioned licensee, a person licensed Linder the
' Beverage Law, , or your agent(s), officer(s $), Servant(s), or employee(s), did unlawfully on your
licensed premises, allow or permit a person, to wit: Bassam Abu-Diab to engage in the operation of
a business as a Pawnbroker without.a license, this act being contrary to and in violation of
§39.001(17)(A), Florida Statutes, within 561.29(1)(a), Florida Statutes.
