Deputy Agency Clerk STATE OF FLORIDA CLERK cate seep rotor DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULA 5. 734/2044 File # DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, BOARD OF ARCHITECTURE AND INTERIOR DESIGN, Petition er, vs. CASE NO.: 2012-051748 INNOVATIVE INTERIORS, INC., AND GLADYS LANDA, Respondents. / ADMINISTRATIVE COMPLAINT Petitioner, DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION, ("Petitioner"), files this Administrative Complaint before the Board. of Architecture and Interior Design against INNOVATIVE INTERIORS, INC. and GLADYS LANDA, ("Respondents"), and says: 1. Petitioner is the state agency charged with regulating the practice of interior design pursuant to Section 20.165, Florida Statutes, and Chapters 455 and 481, Florida Statutes. m Respondent, Innovative Interiors, Inc., is and has been at all times material hereto, a licensed interior design firm in the State of Florida, having been issued license number IBC000246. 3. Respondents’ address of record is 1236 7" Avenue, Fort Lauderdale, FL 33304. 4, On or about August 4, 2011, Respondents contracted with George Behan to perform interior design services at a restaurant located at 2199 Wilton Drive, Wilton Manor, Florida. 5. The contract specifically offers stucco installation, framing, drywall installation, and ceiling installation. 6. Respondents are licensed interior designers and cannot contract for contracting services. 7. Section 481.2251(1)G), Florida Statutes, prohibits a licensed interior designer from accepting and performing professional responsibilities which the licensee knows or has reason to know that she or he is not competent or licensed to perform. 8. Based upon the foregoing, Respondents have violated Section 481.2251(1)(), Florida Statutes by providing contracting services which she is not licensed to perform. WHEREFORE, Petitioner respectfully requests the Board enter an Order imposing one or more of the following penalties: Imposition of probation, reprimand the licensee, revoke, suspend, deny the issuance or renewal of the certificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5,000 per count, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455.227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 481 and 455, Florida Statutes, and/or the rules promulgated thereunder. ts Signed this 24 dayof__ yuely , 2014.
