Comes now, the Division of Alcoholic Beverages and Tobacco, herein after referred to as
“petitioner,” and files this administrative complaint against CHAR PAL INC herein after referred to as
“respondent,” and alleges:

Petitioner is the state agency charged with supervising businesses licensed under the
Florida beverage, tobacco and tax, and tobacco products permit laws pursuant to
sections 559.061, 561.07, 561.15, 561.19, 561.29, 561.501, 210.15, 210,16, 210.45,
210.50, 569.003, and 569.006, Florida Statutes. ee
Respondent is, and has been at all times material hereto, the holder of a valid
license/permit, issued in the State of Florida, by the Division of Alcoholic Beverages
and Tobacco. Respondent's last known mailing address is as follows:

And the division has not been notified of any other designated person or address for
the service of process and notices authorized by Rule 61A-2.012, Florida

Petitioner intends to revoke; suspend; annul; impose civil penalties, investigative
costs, and late penalties; or any combination of these authorized penalties. This
intended action is based on the below described facts or conduct.

employee(s), while on your licensed premises, permitted a patron to unlawfully.sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Tiffani Nicole Hazel did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), within
§61.29(1)(a), Florida Statutes.
2. On 4/19/2012, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted an employee to unlawfully sell,
manufacture, or deliver, or possess with intent to sell, manufacture, or deliver, a controlled
substance as defined in section 893.03(1), Florida Statutes, to wit: Employee Tammy Michelle
Maniscaico did possess a controlled substance, Cannabis, this act being contrary to and in violation
of section 893.13(1)(a), within 561.29(1)(a), Florida Statutes.
3. On 5/24/2012, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, rnanufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron KOA Law did possess and deliver a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(3), within
561.29(1)(a), Florida Statutes.

4. On 6/5/2012, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Johnny Johnson did possess and deliver a
controlled substance, Cannabis, this act being contrary to and in violation of section 893,13(3),
within 561.29(1)(a), Florida Statutes.
5. On 7/19/2012, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron unknown male did possess and sell a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), within
561.29(1)(a), Florida Statutes.

deliver, or possess with intent to sell; manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron unknown male (dreads) did possess and sell a
controlled substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a),
within 561.29(1)(a), Florida Statutes.
7. On 4/19/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or déliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Raymond Flowers did possess and deliver a
controlled substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), -
within 5614.29(1)(a), Florida Statutes.
8. On 5/15/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Raterriarashod Watson did possess a controlled
substance, Cannabis, this act being contrary to and in violation of. section 893.13(1)(a), within
561.29(1)(a), Florida Statutes. .
9. On 6/11/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
_ deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Keith Gaillard (juvenile) did possess and sell a
controlled substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a),
within 561.29(1)(a), Florida Statutes.
10. On 10/3/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(2), Florida Statutes, to wit: Patron Michael Christopher Curry did possess a controlled
substance, Methamphetamine, this act being contrary to and in violation of section 893,13(1)(a),
within 561.29(1)(a), Florida Statutes.
11. On 10/3/2013, you, the aforementidned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Tabatha Maria Sweat did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), within
561.29(1)(a), Florida Statutes.

section 893.03(1), Florida Statutes, to wit: Patron Altone Chavon Robinson did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893,.13(1)(a), within
561.29(1)(a), Florida Statutes.
43. On 10/3/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(2), Florida Statutes, to wit: Patron Wilbert Glenn Young did possess a controlled
substance, Cocaine, this act being contrary to and in violation of section 893.13(1)(a), within
561.29(1)(a), Florida Statutes.
14. On 10/3/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Maurice M. Owens did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), within
561.29(1)(a), Florida Statutes.
15. On 10/3/2013, you, the aforementioned ficensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Shedrick Antuan Houston did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893.13(1)(a), within
561.29(1)(a), Florida Statutes.
16. On 10/3/2013, you, the aforementioned licensee, or your agent(s), officer(s), servant(s), or
employee(s), while on your licensed premises, permitted a patron to unlawfully sell, manufacture, or
deliver, or possess with intent to sell, manufacture, or deliver, a controlled substance as defined in
section 893.03(1), Florida Statutes, to wit: Patron Latisha N. Young did possess a controlled
substance, Cannabis, this act being contrary to and in violation of section 893. 13(1){a), within
§61.29(1)(a), Florida Statutes.
17, Between March 25, 2012 and October 3, 2013, you, the aforementioned licensee, holding a
license under the Beverage Law, or your agent(s), officer(s), servant(s), or employee(s), while on
your licensed premises, did keep or maintain any store, shop, warehouse, dwelling, building, vehicle,
boat, aircraft, or other structure or place which is resorted to by persons using, keeping or selling
controlled substances, this act being contrary to and in violation of section 893.13(7)(a)5, within
561.29(1)(a), Florida Statutes.
