STATE OF FLORIDA EDUCATION PRACTICES COMMISSION PAM STEWART, as Commissioner of Education, Petitioner, vs. CASE NO. 145-0607 ALIA MOHAMMED KASEM, Respondent. / ADMINISTRATIVE COMPLAINT Petitioner, Pam Stewart, as Commissioner of Education, files this Administrative Complaint against ALIA MOHAMMED KASEM. The Petitioner seeks the appropriate disciplinary sanction of the Respondent’s educator’s certificate pursuant to Sections 1012.315, 1012.795, and 1012.796, Florida Statutes, and pursuant to Rule 6A-10.081,. Florida Administrative Code, Principles of Professional Conduct for the Education Profession in Florida, said sanctions specifically set forth in Sections 1012.795(1) and 1012.796(7), Florida Statutes, The Petitioner alleges: JURISDICTION L. The Respondent holds Florida Educator's Certificate 1146015, covering the areas of Elementary Education, English for Speakers of Other Languages ( ESOL), Mathematics, Middle Grades Integrated Curriculum and Reading and Exceptional Student Education, which is valid through June 30, 2020. 2. At all times pertinent hereto, the Respondent was employed as a Mathematics Teacher at Liberty Middle School in the Marion County School District. MATERIAL ALLEGATIONS 3. On or about April 1, 2014, Respondent signed the E.O.C. Test Administrator Prohibited Activities Agreement whereby Respondent, among other things, agreed not to answer student questions about the test, read test items or give students verbal or non-verbal cues. On the same date, Respondent signed the FCAT 2.0 Test Administration and Security Agreement. ALIA MOHAMMED KASEM Administrative Complaint Page 2 of 4 4, On or about May 14, 2014, during the course of administering the Florida Department of Education Algebra 1 End of Course (EOC) exam to a section of her students, Respondent aided students by providing hand and verbal cues. Respondent indicated by approving or disapproving sounds whether student answers were correct or not. Additionally Respondent made gestures or signs on student desks to indicate correct answers and/or whispered answers to students, 5. On or about May 16, 2014, the EOC tests administered by Respondent on May 14, 2016, were invalidated. 6. On or about July 22, 2014, Respondent was issued a twenty day suspension from her teaching position with the District as a result of her actions, The Petitioner charges: STATUTE VIOLATIONS COUNT 1: The Respondent is in violation of Section 1008.24(1), Florida Statutes, in that Respondent knowingly and willfully violated test security rules adopted by the State Board of Education for mandatory tests administered by or through the State Board of Education or the Commissioner of Education to students, educators, or applicants for certification or administered by school districts pursuant to Section 1008.22. COUNT 2: The Respondent is in violation of Section 1008.24(1)(c), Florida Statutes, in that Respondent coached examinees during testing or altered or interfered with examinees’ responses. COUNT 3: The Respondent is in violation of Section 008.24(1)(£), Florida Statutes, in that Respondent knowingly and willfully failed to follow test administration directions specified in the test administration manuals, COUNT 4: The Respondent is in violation of Section 008.24(1)(g), Florida Statutes, in that Respondent participated in, directed, aided, counseled, assisted in, or encouraged any of the acts prohibited in this section. COUNT 5: The Respondent is in violation of Section 012.795(1)(g), Florida Statutes, in that Respondent has been found guilty of personal conduct which seriously reduces effectiveness as an employee of the schoo! board. COUNT 6: The Respondent is in violation of Section 1012.795(1)q), Florida Statutes, in that Respondent has violated the Principles of Professional Conduct for the Education Profession prescribed by State Board of Education rules. ALIA MOHAMMED KASEM Administrative Complaint Page 3 of 4 RULE VIOLATIONS COUNT 7; The allegations of misconduct set forth herein are in violation of Rule 6A- 10.042(1)}, Florida Administrative Code, in that Respondent failed to maintain/administer tests in a manner to preserve test integrity. COUNT 8: The allegations of misconduct set forth herein are in violation of Rule 6A- 10.042(1)(c), Florida Administrative Code, in that Respondent assisted examinees in answering questions. COUNT 9: The allegations of misconduct set forth herein are in violation of Rule 6A- 10.042(1)(d), Florida Administrative Code, in that Respondent interfered with examinees answers while administering test. COUNT 10: The allegations of misconduct set forth herein are in violation of Rule 6A- 10.042(1)(f), Florida Administrative Code, in that Respondent has participated in, directed, aided counseled, assisted in, or encouraged an activity which could result in the inaccurate measurement or reporting of examinees! achievement. COUNT Ii: The allegations of misconduct set forth herein are in violation of Rule 6A- 10.081(3)(a), Florida Administrative Code, in that Respondent has failed to make reasonable effort to protect the student from conditions harmful to learning and/or to the student’s mental health and/or physical health and/or safety, COUNT 12: The allegations of misconduct set forth herein are in violation of Rule 6A- 10.081(5)(a), Florida Administrative Code, in that Respondent has failed to maintain honesty in all professional dealings.
