DAWSON, 2016-046709 Respondent. / ADMINISTRATIVE COMPLAINT The Department of Business and Professional Regulation, Divi- sion of Pari-—Mutuel Wagering (“Petitioner”), files this Administrative Complaint against Robert G. Dawson, (“Respondent”) and alleges as follows: 1. The Petitioner is the state agency charged with regulating pari-mutuel wagering pursuant to Chapter 550, Florida Statutes. 2. Palm Beach Kennel Club is a facility operated by a per- mitholder authorized to conduct pari-mutuel wagering in this state under Chapter 550, Florida Statutes. 3. At all times material hereto, Respondent held a pari-mutuel wagering professional individual occupational license, number 333293-1021, issued by the Division. 4. Pursuant to Section 550.2415(1) (a), Florida Statutes (2016), “the racing of an animal that has been impermissibly medi- cated or determined to have a prohibited substance present is prohibited. It is a violation of this section for a person to im- permissibly medicate an animal or for an animal to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from the animal before or immediately after the racing of that animal.” 5. Section 550.2415(1)(c), Florida Statutes (2016), states, “[t]he finding of a prohibited substance in a race-day specimen constitutes prima facie evidence that the substance was adminis- tered and was carried in the body of the animal while participating in the race.” 6. Rule 61D-6.002(1), Florida Administrative Code (2016), pro- vides, "[t]he trainer of record shall be responsible for and be the absolute insurer of the condition of the .. racing greyhounds he/she enters to race." Facts Specific to Sample No. 097466 7. At all times material hereto, Respondent was the trainer of record of the racing greyhound “PJ HO HEY,” tattoo number 5879362A, 8. On or about September 4, 2016, “PJ HO HEY” finished in sec- ond place in the eleventh race at Palm Beach Kennel Club. 9. On or about September 4, 2016, a Division employee collect- ed urine sample number 097466 from “PJ HO HEY.” 10.Sample number 097466 was processed in accordance with es- tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. Facts Specific to Sample No. 104746 11.At all times material hereto, Respondent was the trainer of record of the racing greyhound “PJ SMOKEEMOUT,” tattoo number S921172A,. 12.0n or about September 9, 2016, “PJ SMOKEEMOUT” finished in second place in the tenth race at Palm Beach Kennel Club. 13.0On or about September 9, 2016, a Division employee collect- ed urine sample number 104746 from “PJ SMOKEEMOUT.” 14.Sample number 104746 was processed in accordance with es-— tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. Facts Specific to Sample No. 104694 15.At all times material hereto, Respondent was the trainer of record of the racing greyhound “JIMS GRAND SLAM,” tattoo number 6320224D. 16.0n or about September 5, 2016, “JIMS GRAND SLAM” finished in third place in the seventh race at Palm Beach Kennel Club. 17.On or about September 5, 2016, a Division employee collect- ed urine sample number 104694 from “JIMS GRAND SLAM.” 18.Sample number 104694 was processed in accordance with es- tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. Facts Specific to Sample No. 097442 19.At all times material hereto, Respondent was the trainer of record of the racing greyhound “BOB’S SEAHAWK,” tattoo number 6455884B. 20.On or about September 3, 2016, “BOB’S SEAHAWK” finished in third place in the eleventh race at Palm Beach Kennel Club. 21.0n or about September 3, 2016, a Division employee collect- ed urine sample number 097442 from “BOB’S SEAHAWK.” 22.Sample number 097442 was processed in accordance with es- tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. Facts Specific to Sample No. 097486 23.At all times material hereto, Respondent was the trainer of record of the racing greyhound “BS ANGEL,” tattoo number 6386454C. 24.On or about September 7, 2016, “BS ANGEL” finished in sec- ond place in the fifteenth race at Palm Beach Kennel Club. 25.On or about September 7, 2016, a Division employee collect- ed urine sample number 097486 from “BS ANGEL.” 26.Sample number 097486 was processed in accordance with es- tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. Facts Specific to Sample No. 106083 27.At all times material hereto, Respondent was the trainer of record of the racing greyhound “CENTEX WIZARD,” tattoo number 6335424F. 28.On or about September 17, 2016, “CENTEX WIZARD” finished in second place in the fourth race at Palm Beach Kennel Club. 29.On or about September 17, 2016, a Division employee col- lected urine sample number 106083 from “CENTEX WIZARD.” 30.Sample number 106083 was processed in accordance with es- tablished procedures and forwarded to the University of Florida Racing Laboratory (“the lab”) for analysis. COUNT I (DBPR Case No. 2016-045175) 31.Petitioner realleges and incorporates paragraphs one through ten as though fully set forth herein. 32.The lab tested sample number 097466 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of caffeine in the sample was 4.555 +/- 0.03 pg/mL. 33.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ HO HEY,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “PJ HO HEY” before or immediately after the racing of “PJ HO HEY” on or about September 4, 2016. COUNT II (DBPR Case No. 2016-045175) 34.Petitioner realleges and incorporates paragraphs one through ten as though fully set forth herein. 35.The lab tested sample number 097466 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 1.23 +/- 0.09 pg/mL. 36.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ HO HEY,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “PJ HO HEY” before or immediately after the racing of “PJ HO HEY” on or about September 4, 2016. COUNT III (DBPR Case No. 2016-045175) 37.Petitioner realleges and incorporates paragraphs one through ten as though fully set forth herein. 38.The lab tested sample number 097466 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 3.235 +/- 0.08 pg/mL. 39.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ HO HEY,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “PJ HO HEY” before or immediately after the racing of “PJ HO HEY” on or about September 4, 2016. COUNT IV_ (DBPR Case No. 2016-045175) 40.Petitioner realleges and incorporates paragraphs one through six and eleven through fourteen as though fully set forth herein. 41.The lab tested sample number 104746 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of caffeine in the sample was 2.392 +/- 0.03 pg/mL. 42.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ SMOKE EM OUT,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “PJ SMOKE EM OUT” before or immediately after the racing of “PJ SMOKE EM OUT” on or about September 9, 2016. COUNT V_(DBPR Case No. 2016-045175) 43.Petitioner realleges and incorporates paragraphs one through six and eleven through fourteen as though fully set forth herein. 44.The lab tested sample number 104746 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 1.893 +/- 0.09 pg/mL. 45.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ SMOKE EM OUT,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “PJ SMOKE EM OUT” before or immediately after the racing of “PJ SMOKE EM OUT” on or about September 9, 2016. COUNT VI (DBPR Case No. 2016-045175) 46.Petitioner realleges and incorporates paragraphs one through six and eleven through fourteen as though fully set forth herein. 47.The lab tested sample number 104746 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 4.169 +/- 0.08 pg/mL. 48.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “PJ SMOKE EM OUT,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “SMOKE EM OUT” before or immediately after the racing of “PJ SMOKE EM OUT” on or about September 9, 2016. COUNT VII (DBPR Case No. 2016-045175) 49,Petitioner realleges and incorporates paragraphs one through six and fifteen through eighteen as though fully set forth herein. 50.The lab tested sample number 104694 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of caffeine in the sample was 3.911+/- 0.03 pg/mL. 51.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “JIMS GRAND SLAM,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “JIMS GRAND SLAM” before or immediately after the racing of “JIMS GRAND SLAM” on or about September 5, 2016. COUNT VIII (DBPR Case No. 2016-045175) 52.Petitioner realleges and incorporates paragraphs one through six and fifteen through eighteen as though fully set forth herein. 53.The lab tested sample number 104694 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 1.107 +/- 0.09 pg/mL. 54.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “JIMS GRAND SLAM,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “JIMS GRAND SLAM” before or immediately after the racing of “JIMS GRAND SLAM” on or about September 5, 2016. COUNT IX (DBPR Case No. 2016-045175) 55.Petitioner realleges and incorporates paragraphs one through six and fifteen through eighteen as though fully set forth herein. 56.The lab tested sample number 104694 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a -10- class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 2.881 +/- 0.08 pg/mL. 57.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “JIMS GRAND SLAM,” a greyhound that was impermissibly medicated or that was de- termined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “JIMS GRAND SLAM” before or immediately after the racing of “JIMS GRAND SLAM” on or about September 5, 2016. COUNT X (DBPR Case No. 2016-045175) 58.Petitioner realleges and incorporates paragraphs one through six and nineteen through twenty-two as though fully set forth herein. 59.The lab tested sample number 097442 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of caffeine in the sample was 1.946 +/- 0.03 pg/mL. 60.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BOB’S SEAHAWK,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test -ll- for such medications or substances based on samples taken from “BOB’S SEAHAWK” before or immediately after the racing of ™“BOB’S SEAHAWK” on or about September 3, 2016. COUNT XI (DBPR Case No. 2016-045175) 61.Petitioner realleges and incorporates paragraphs one through six and nineteen through twenty-two as though fully set forth herein. 62.The lab tested sample number 097442 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 859 +/- 90 ng/mL. 63.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BOB’S SEAHAWK,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “BOB’S SEAHAWK” before or immediately after the racing of “BOB’S SEAHAWK” on or about September 3, 2016. COUNT XII (DBPR Case No. 2016-045175) 64.Petitioner realleges and incorporates paragraphs one through six and nineteen through twenty-two as though fully set forth herein. -12- 65.The lab tested sample number 097442 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 2.462 +/- 0.08 pg/mL. 66.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BOB’S SEAHAWK,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “BOB’S SEAHAWK” before or immediately after the racing of “BOB’S SEAHAWK” on or about September 3, 2016. COUNT XIII (DBPR Case No. 2016-045175) 67.Petitioner realleges and incorporates paragraphs one through six and twenty-three through twenty-six as though fully set forth herein. 68.The lab tested sample number 097486 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of caffeine in the sample was 4.551 +/- 0.03 pg/mL. 69.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BS ANGEL,” a -13- greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “BS ANGEL” before or immediately after the racing of “BS ANGEL” on or about September 7, 2016. COUNT XIV (DBPR Case No. 2016-045175) 70.Petitioner realleges and incorporates paragraphs one through six and twenty-three through twenty-six as though fully set forth herein. 71.The lab tested sample number 097486 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 3.056 +/- 0.09 pg/mL. 72.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BS ANGEL,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “BS ANGEL” before or immediately after the racing of “BS ANGEL” on or about September 7, 2016. -14- COUNT XV_(DBPR Case No. 2016-045175) 73.Petitioner realleges and incorporates paragraphs one through six and twenty-three through twenty-six as though fully set forth herein. 74.The lab tested sample number 097486 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 8.05 +/- 0.08 pg/mL. 75.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “BS ANGEL,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “BS ANGEL” before or immediately after the racing of “BS ANGEL” on or about September 7, 2016. COUNT XVI _ (DBPR Case No. 2016-046709) 76.Petitioner realleges and incorporates paragraphs one through six and twenty-seven through thirty as though fully set forth herein. 77.The lab tested sample number 106083 and found that it con- tained caffeine, a central nervous system stimulant and a class 2 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, -15- Inc. The concentration of caffeine in the sample was 2.457 +/- 0.03 pg/mL. 78.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “CENTEX WIZARD,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “CENTEX WIZARD” before or immediately after the racing of “CENTEX WIZARD” on or about September 17, 2016. COUNT XVII (DBPR Case No. 2016-046709) 79.Petitioner realleges and incorporates paragraphs one through six and twenty-seven through thirty as though fully set forth herein. 80.The lab tested sample number 106083 and found that it con- tained theobromine, a diuretic/smooth muscle relaxant and a class 4 drug under the Uniform Classification Guidelines for Foreign Sub- stances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theobromine in the sample was 664 +/- 90 ng/mL. 81.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “CENTEX WIZARD,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from -16- “CENTEX WIZARD” before or immediately after the racing of “CENTEX WIZARD” on or about September 17, 2016. COUNT XVIII (DBPR Case No. 2016-046709) 82.Petitioner realleges and incorporates paragraphs one through six and twenty-seven through thirty as though fully set forth herein. 83.The lab tested sample number 106083 and found that it con- tained theophylline, a bronchodilator/smooth muscle relaxant and a class 3 drug under the Uniform Classification Guidelines for For- eign Substances, as promulgated by the Association of Racing Commissioners, Inc. The concentration of theophylline in the sam- ple was 1.69 +/- 0.08 ug/ml. 84.Based on the foregoing, Respondent violated Section 550.2415(1) (a), Florida Statutes (2016), by racing “CENTEX WIZARD,” a greyhound that was impermissibly medicated or that was determined to have a prohibited substance present resulting in a positive test for such medications or substances based on samples taken from “CENTEX WIZARD” before or immediately after the racing of “CENTEX WIZARD” on or about September 17, 2016. WHEREFORE, Petitioner respectfully requests the Division enter an Order imposing against Respondent one or more of the penalties specified in Rule 61D-6.012, Florida Administrative Code, Section 550.2415(3) (a), Florida Statutes, and/or any other relief that the Division is au- -17- thorized to impose pursuant to Chapter 550, Florida Statutes, and/or the rules promulgated thereunder.
