The State of Florida, Office of Financial Regulation, (“Office”) files this Administrative Complaint against GISLASON, JOHN LAWRENCE (“Respondent”), alleging: GENERAL ALLEGATIONS i. Pursuant to section 494.001, Florida Statutes, the Office is charged with administering and enforcing the provisions of Chapter 494, Florida Statutes. 2. Atno time material was Respondent licensed as a loan originator, mortgage lender or mortgage broker pursuant to Chapter 494, Florida Statutes. 3. Section 494.00255(1)(p), Florida Statutes, states that it is a violation to act as a loan originator, mortgage broker, or mortgage lender without a current license issued under part II or part III of Chapter 494, Florida Statutes. 4. Section 494.001(18), Florida Statutes, defines ‘loan originator’ as: [A]n individual who, directly or indirectly, solicits or offers to solicit a mortgage loan, accepts or offers to accept an application for a mortgage loan, negotiates or offers to negotiate the terms or conditions of a new or existing mortgage loan on behalf of a borrower or lender, or negotiates or offers to negotiate the sale of an existing mortgage loan to a noninstitutional investor for compensation or gain. From June 18, 2014 through July 16, 2014, Respondent acted as a loan originator for compensation or gain, in violation of section 494.00255(1)(p), Florida Statutes. 6. Pursuant to section 494.00255(2)(f), Florida Statutes, an unlicensed person who acts as a loan originator is subject to an administrative fine of up to $1,000 per day, but not to exceed $25,000 cumulatively. 7. Therefore, the Office is seeking a fine of $25,000. WHEREFORE, Respondent, GISLASON, JOHN LAWRENCE is hereby notified that the Office intends to enter an Order imposing an administrative fine of $25,000.00.
