COMES NOW the Department of Agriculture and Consumer Services, Division of
Licensing, pursuant to Section 493.6121, Florida Statutes, and states that it is the licensing
authority as defined therein, that it has statutory jurisdiction over the Respondent, and alleges:

Respondent holds the following license(s) issued pursuant to Chapter 493, Florida
Statutes:
C 9900482.
As set forth below, Petitioner has received information that justifies action provided for in
Section 493.6118(2), Florida Statutes.
Count |
On or about December 15, 2015, in Duval County, Florida, Respondent was convicted of
resisting officer without violence to his or her person, a crime directly related to the business for
which Respondent's license is held. Respondent is ineligible for licensure pursuant to section
493.6118(1)(c), Florida Statutes.
WHEREFORE, Petitioner intends to take disciplinary action pursuant to Section
493.6118(2), Florida Statutes, including, but not limited to a reprimand, probation, administrative
fine, suspension of license, or revocation of license.

NOTICE OF RIGHTS
In accordance with Sections 120.569 and 120.57, Florida Statutes, you the Respondent
may request a formal hearing or an informal hearing, or you may enter into a stipulation and
settlement.
To request a hearing, you must complete the enclosed Election of Rights form and file it
with the Division of Licensing within 21 days of receipt of this complaint. If you request a formal
hearing, you must also provide a statement of the material facts alleged in this complaint that you
dispute.
To enter into a stipulation and settlement, sign and return the attached Stipulation and
Settlement, which is an agreement to accept the suggested penalty without proceeding to a
hearing.
Failure to file the Election of Rights form with the Division of Licensing within 21
days of receipt of this administrative complaint shall be considered a waiver of your right
to a hearing and shall result in the issuance of a final order without the benefit of a hearing.
The final order will notify you of the right to appeal the final order pursuant to Section
120.68, Florida Statutes.

STIPULATION AND SETTLEMENT
The parties to this action, Department of Agriculture and Consumer Services, Division of
Licensing, and Michale A. Hoffman, Respondent, do hereby stipulate and agree to the following:
1. The Division has regulatory authority over this matter pursuant to Section 493.6121,
Florida Statutes.
2. Respondent agrees to the revocation of license number(s) C 9900482. and to return said
licenses to the Division of Licensing with this agreement.
3. Each party shall be responsible for its own costs and fees.
4. Respondent shall cease and desist engaging in any activities regulated by Chapter 493,
Florida Statutes, until such time as Respondent has met the licensure requirements of this
chapter.
5. Section 120.68, Florida Statutes, allows for judicial review of final agency action.
Respondent hereby waives all rights to appeal and further review of this Stipulation and
Settlement and these proceedings.
6. This Stipulation and Settlement shall become a Final Order upon filing with Agency Clerk.
