Now before the court is Defendant's Motion to Dismiss (Doc. #17) and Plaintiffs' Motion for Leave to File Amended Complaint (Doc. #23). Having fully considered these motions, it is hereby ORDERED that Plaintiffs' Motion for Leave to File Amended Complaint (Doc. #23) is GRANTED, and Plaintiffs shall file the amended complaint attached as Exhibit A to Doc. #23 on or before October 3, 2014. It is further ORDERED that Defendant's Motion to Dismiss (Doc. #17) is DENIED with leave to refile following the filing of Plaintiffs' amended complaint.
