REPORT AND RECOMMENDATION CONCERNING PLEA OF GUILTY
KATHERINE P. NELSON, Magistrate Judge.
The Defendant RIGOBERTO CAMPOS LEMOS aka REGOBERTO LEMOS CAMPOS aka RIGOBERTO CAMPOS LEMUS by consent (Doc. 17), has appeared before the undersigned pursuant to Rule 11 of the Federal Rules of Criminal Procedure, and has entered a plea of guilty to Count One of the Indictment charging a violation of 8 U.S.C. § 1326(a) and (b) illegal re-entry into the United States of America after removal. The Defendant's plea was entered without a written plea agreement.
After cautioning and examining the Defendant under oath concerning each of the subjects mentioned in Rule 11, the Court determined that the guilty plea was knowledgeable and voluntary and the offense charged is supported by an independent basis in fact as to each of the essential elements of the offense. The Court therefore recommends that the plea of guilty be accepted and that the Defendant be adjudged guilty and have sentence imposed accordingly.
