This action is essentially one for fraud and breaches of both contract and fiduciary duty in conjunction with an alleged investment scheme.
The parties (all but one of them) are now before the court because they cannot agree on the date for when their Fed. R. Civ. P. 26 initial disclosures should be made. This is the first time this court has ever had to referee such a dispute, and it is unfortunate that the parties were so fixed on their own interpretation of the "correct" date that they could not reach a compromise.
The court determines that initial disclosures shall be exchanged no later than 5 days after the filing of this order.
