JUDGMENT AND PERMANENT INJUNCTION as to Defendants Kenneth J. Doeing a/k/a Kenneth James Doeing and QinQin Pan a/k/a PanQing Qing a/k/a Tiffany Qinga/k/a Tiffany Pan a/k/a Maria Pan

The Court, having read and considered the Joint Stipulation Re Entry of Proposed Judgment and Order that has been executed by Plaintiffs Sanrio, Inc. and Disney Enterprises, Inc. (collectively "Plaintiffs"), on the one hand, and Defendants Kenneth J. Doeing a/k/a Kenneth James Doeing ("Doeing") and QinQin Pan a/k/a PanQing Qing a/k/a Tiffany Qing a/k/a Tiffany Pan a/k/a Maria Pan ("Pan") (collectively "Defendants"), on the other hand, in this action, in light of the Order re Nondischargeability of a Debt Pursuant to 11 U.S.C. § 523(a)(6) and Entry of Judgment entered by the United States Bankruptcy Court, Central District of California in Adversary No.: 2:16-ap-01214-ER:
AND GOOD CAUSE APPEARING THEREFORE, the Court finds the following facts:
Plaintiffs are the owners or exclusive licensees of all rights in and to the copyright and trademark registrations including, but not limited to, those listed in Exhibits "A" through "D," attached hereto and incorporated by this reference (hereinafter "Plaintiffs' Properties").
Plaintiffs have complied in all respects with the laws governing copyrights and trademarks and have secured the exclusive rights and privileges in and to Plaintiffs' Properties;
The appearance and other qualities of Plaintiffs' Properties are distinctive and original;
This Court has found that Defendants engage in the unauthorized business of importing, distributing, promoting, selling and/or offering for sale unauthorized fabric and related merchandise featuring Plaintiffs' Properties ("Unauthorized Product").
The Court has found that Defendants' importing, advertising, displaying, promoting, marketing, distributing, providing, offering for sale and selling of the Unauthorized Product was engaged in without leave or license from Plaintiffs, in violation of Plaintiffs' rights in and to Plaintiffs' Properties. The devices, emblems, and artwork on the Unauthorized Product are not just "confusingly similar" to Plaintiffs' Properties, they are identical.
The Court has found that the liability of the Defendants in the above-referenced action for their acts is in violation of Plaintiffs' rights, and as such the Court expressly finds that there is no just reason for delay in entering the judgment and permanent injunction sought herein. Therefore, based upon the foregoing facts, and
GOOD CAUSE APPEARING THEREFORE, THE COURT ORDERS that this Judgment shall be and is hereby entered in the within action as follows:
1) This Court has jurisdiction over the parties to this action and over the subject matter hereof pursuant to 15 U.S.C. § 1051 et seq., 28 U.S.C. §§ 1331 and 1338, and 28 U.S.C. § 1367. Service of process was properly made on the Defendants.
2) The Court has found that Defendants have manufactured, imported, distributed, sold, and offered for sale unauthorized fabric and related merchandise which infringe upon Plaintiffs' Properties.
3) The Defendants and their agents, servants, employees and all persons in active concert and participation with them who receive actual notice of the injunction are hereby restrained and enjoined from:
a) Infringing Plaintiffs' Properties, either directly or contributorily, in any manner, including generally, but not limited to manufacturing, importing, distributing, advertising, selling and/or offering for sale any unauthorized product which features any of Plaintiffs' Properties, and, specifically:
i) Importing, manufacturing, distributing, advertising, selling and/or offering for sale the Unauthorized Products or any other unauthorized products which picture, reproduce, copy or use the likenesses of or bear a substantial similarity to any of Plaintiffs' Properties;
ii) Importing, manufacturing, distributing, advertising, selling and/or offering for sale in connection thereto any unauthorized promotional materials, labels, packaging or containers which picture, reproduce, copy or use the likenesses of or bear a confusing similarity to any of Plaintiffs' Properties;
iii) Engaging in any conduct that tends falsely to represent that, or is likely to confuse, mislead or deceive purchasers, the Defendants' customers and/or members of the public to believe, the actions of Defendants, the products sold by Defendants, or the Defendants themselves are connected with Plaintiffs, is sponsored, approved or licensed by Plaintiffs, or is affiliated with Plaintiffs; or
iv) Affixing, applying, annexing or using in connection with the importation, manufacture, distribution, advertising, sale and/or offer for sale or other use of any goods or services, a false description or representation, including words or other symbols, tending to falsely describe or represent such goods as being those of Plaintiffs.
4) Plaintiffs are entitled to and shall recover from Defendants on Plaintiffs' Complaint for Defendants' infringement the sum of Two Hundred Fifty Thousand Dollars ($250,000.00).
5) Plaintiffs are entitled to and shall recover from Defendants interest accruing upon any unpaid portion of said $250,000.00, less any amounts already paid, at the rate of ten percent (10%) per annum from the date of entry of Judgment until such Judgment is paid in full.
6) Each side shall bear its own fees and costs of suit.
7) Plaintiffs are further entitled to, and shall collectively recover from Defendants, their actual attorneys' fees, costs and expenses incurred after the date hereof relating to or in connection with enforcing, executing on, collecting on or confirming this Judgment, according to proof. The Court hereby retains jurisdiction to award such attorneys' fees, costs and expenses upon motion or application by Plaintiffs or their counsel.
8) Enforcement actions undertaken by Plaintiffs against Defendants are not subject to any bankruptcy or other stay.
9) Defendants' debt and liability to Plaintiffs constitutes a willful and malicious injury excepted from discharge pursuant to 11 U.S.C. § 523(a)(6).
10) Defendants agree and stipulate that no portion of this Judgment is dischargeable in any way, in any current or future bankruptcy proceeding.
11) This Judgment will be valid, enforceable and Plaintiffs may execute on this Judgment as soon as it is executed by the Court.
12) This Judgment shall be deemed to have been served upon Defendants at the time of its execution by the Court.
13) The Court finds there is no just reason for delay in entering this Judgment and, pursuant to Rule 54(a) of the Federal Rules of Civil Procedure, the Court directs immediate entry of this Judgment and Permanent Injunction against Defendants.
14) The Court shall retain jurisdiction of this action to entertain such further proceedings and to enter such further orders as may be necessary or appropriate to implement and enforce the provisions of this Judgment.
