JOINT STIPULATION AND [PROPOSED] ORDER CONTINUING FINAL PRE-TRIAL CONFERENCE
RICHARD SEEBORG, District Judge.
This Stipulation is entered into by and among Plaintiff Kathleen Sonner ("Plaintiff") and Defendant Premier Nutrition Corporation ("Defendant") (collectively "Parties"), by and through their respective counsel.
WHEREAS, the Parties are scheduled to begin trial on September 18th;
WHEREAS, the Parties are scheduled to conduct a final pre-trial conference on August 17th;
WHEREAS, the Parties are scheduled to exchange certain pre-trial disclosures and statements in advance of the pre-trial conference;
WHEREAS, the Parties are still actively conducting expert discovery and depositions until the end of the first week of August, during the same period they are scheduled to exchange certain pre-trial disclosures and statements.
WHEREAS, the Parties do not seek to or want to alter the scheduled trial date.
NOW, THEREFORE, pursuant to Civil Local Rule 6-2(a), the Parties hereby stipulate and agree, through their respective counsel:
1. The August 17, 2017 Final Pre-Trial Conference shall be taken off calendar, and rescheduled fourteen (14) days later on August 31, 2017, or on another later date that is convenient for the Court, thereby postponing all pre-trial disclosure deadlines associated with the Final Pre-Trial Conference by the same time frame, to allow the Parties time to complete expert discovery and depositions before engaging in pre-trial disclosures. By this stipulation, the Parties do not seek to or want to change the scheduled trial date in any way.
IT IS SO STIPULATED.
PURSUANT TO STIPULATION, IT IS HEREBY ORDERED that the Stipulation to Continue the Final Pre-Trial Conference is GRANTED.
The Final Pre-Trial scheduled for August 17, 2017 is taken off calendar and rescheduled to September 1, 2017 at 10:00 am.
IT IS SO ORDERED.
