STIPULATON AND DECLARATION CONTINUING CASE MANAGEMENT CONFERENCE; [PROPOSED] ORDER

CONTINUING CASE MANAGEMENT CONFERENCE; DIRECTING ALL PARTIES TO APPEAR TELEPHONICALLY

STIPULATION

Pursuant to Civil L.R. 6-2, Plaintiffs DTL Corporacion, S.L. and Solaria Energia y Medioambiente and Defendant Solaria Corporation, by and through their respective counsel, hereby stipulate and agree, subject to the Court's approval, to continue the Case Management Conference currently scheduled for August 25, 2017 at 10:30 a.m., to September 8, 2017 at 10:30 a.m.

SO STIPULATED.

DECLARATION

I, Theodore T. Herhold, declare as follows:

1. I am counsel of record for Defendant in this matter. I make this Declaration of my own personal knowledge and would and could competently testify to the facts below if called upon to do so.

2. The Case Management Conference in this matter is currently scheduled for August 25, 2017 at 10:30 a.m.

3. I have a vacation scheduled with my family from August 22, 2017 through September 6, 2017, which was planned before the CMC in this matter was set.

4. Defendant requests, and Plaintiff agrees, that the CMC be continued to September 8, 2017 at 10:30 a.m.

5. No other time modifications have been sought or obtained in this case.

6. Except as otherwise requested herein, the requested continuance will not affect the schedule for this case.

7. Counsel for Plaintiff has requested to appear by telephone. Defendant has no objection to the request.

I declare under penalty of perjury under the laws of the United States that the foregoing is true and correct. Executed this 24th day of July 2017 at Redwood Shores, CA.

PURSUANT TO STIPULATION, IT IS SO ORDERED.

IT IS FURTHER ORDERED that plaintiffs' request to appear by telephone at the September 8, 2017 Case Management Conference, which request defendant has indicated it does not oppose, is hereby GRANTED, andall parties are hereby DIRECTED to appear at the Case Management Conference by telephone.
