ORDER ACCEPTING FINDINGS AND RECOMMENDATIONS OF U.S. MAGISTRATE JUDGE
PHILIP S. GUTIERREZ, District Judge.
Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, records on file, and Report and Recommendation of U.S. Magistrate Judge. No objections to the Report and Recommendation have been filed.1 The Court accepts the findings and recommendations of the Magistrate Judge.
IT THEREFORE IS ORDERED that the Petition be dismissed under Youncter v. Harris, 401 U.S. 37, 45-46 (1971), and Judgment be entered dismissing this action without prejucjice.

Further, Petitioner's argument that the vacancy on the state supreme court might delay resolution of his case there and cause him to suffer irreparable harm (see R. & R. at 7 & n.2) is now even less compelling since the Governor nominated someone to fill that position.
