STIPULATION TO MAGISTRATE JUDGE SPERO AND REQUEST TO POSTPONE JULY 31, 2017 CASE MANAGEMENT CONFERENCE

Pursuant to the Court's Order (Dkt. 23) the undersigned parties have met and conferred and hereby agree to STIPULATE, and jointly request Magistrate Judge Joseph C. Spero be assigned to conduct any and all further proceedings in the case, including trial, and order the entry of a final judgment. Appeal from the judgment shall be taken directly to the United States Court of Appeals for the Ninth Circuit.

The parties also request that the Case Management Conference presently set for July 31, 2017, be postponed or vacated in light of the stipulation, and because defense counsel is not available to appear on that date due to a pre-planned family vacation.

ORDER

PURSUANT TO STIPULATION, AND GOOD CAUSE FOUND, THIS MATTER IS HEREBY REFERRED to Magistrate Judge Joseph C. Spero to conduct any and all further proceedings in the case, including trial, and order of the entry of a final judgment.

The initial case management conference presently set for July 31, 2017, is vacated pending reassignment to Magistrate Judge Spero.
