ORDER GRANTING THE MOTION OF UNITED STATES TRUSTEE TO DISMISS CHAPTER 7 CASE WITH A REFILING BAR PURSUANT TO 11 U.S.C. §§ 707(b)(3)(A), 349 AND 105(a) AND DISMISSING CASE WITH TWO YEAR BAR ON FILING A NEW BANKRUPTCY CASE AND DENYING DEBTOR'S MOTION TO CONVERT CASE AS MOOT
ROBERT KWAN, Bankruptcy Judge.
Having issued its memorandum decision on the motion of Peter C. Anderson, United States Trustee for the Central District of California to Dismiss Chapter 7 Case with a Refiling Bar pursuant to 11 U.S.C. § 707(b)(3)(A), or, in the alternative, to Further Extend Time to File a Complaint Under § 727, Electronic Case Filing (ECF) Number 22, filed on August 12, 2019 (Motion to Dismiss), setting forth its reasons for its rulings on the motions pending before the court, the court orders as follows:
1. The Motion to Dismiss is granted.
2. The alternate request for an order further extending the bar date for the filing of a complaint for denial of discharge under 11 U.S.C. § 727 is denied.
3. Debtor's Motion to Convert the case to one under Chapter 13 is denied.
4. The bankruptcy case is dismissed.
5. Debtor is prohibited from filing a new bankruptcy case for two years from the date of entry of this order.
IT IS SO ORDERED.
