STIPULATED REQUEST FOR DISMISSAL WITH PREJUDICE AND ORDER OF DISMISSAL

TO THE ABOVE ENTITLED COURT AND ALL INTERESTED PARTIES

In accordance with the terms of the Settlement Agreement executed by the parties in the above-captioned action, and pursuant to Rule 41 of the Federal Rules of Civil Procedure, Plaintiff Glen Even and Defendants James L. Comazzi, James L. Comazzi, M.D., Inc., James L. Comazzi, M.D. Inc. Money Purchase Pension Plan, James L. Comazzi, M.D. Inc. Profit Sharing Plan and James L. Comazzi, M.D. Inc. Cash Balance Plan, hereby stipulate and request that this action in its entirety be dismissed with prejudice. Each party shall be responsible for bearing its own costs and attorney's fees incurred in connection with this action and the completion of the settlement of same.

ORDER

The parties having so stipulated,

IT IS HEREBY ORDERED that this action be dismissed with prejudice in its entirety. Each party shall bear its own attorney's fees and costs.

IT IS SO ORDERED.
