STIPULATION AND ORDER TO CONTINUE HEARING

IT IS HEREBY STIPULATED by and between the parties hereto through their respective counsel, ROBERT LAMANUZZI attorney for Defendant BRANDON HOPKINS, and VINCENZA RABENN, Assistant U.S. Attorney for Plaintiff, that the hearing currently scheduled for January 7, 2019, shall be calendared for JANUARY 22, 2019, at 10:00 a.m.

Defendant's counsel needs to continue the hearing due to a juvenile trial scheduled on the same day. Assistant United States Attorney Vincenza Rabin has no objection to the continuance. Ms. Rabin may need to appear by telephone on January 22, 2019, as she has relocated to the Sacramento office.

The parties stipulate that the time until the next hearing should be excluded from the calculation of time under the Speedy Trial Act. The parties stipulate that the ends of justice are served by the court excluding such time, so that counsel for the defendant may have reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. §3161(h)(7)(B)(iv). The parties stipulate and agree that the interests of justice are served by granting this continuance outweigh the best interests of the public and the defendant in a speedy trial. 18 U.S.C. §3161(h)(7)(A).

ORDER

The hearing as to the above named defendant currently scheduled for January 7, 2019, is vacated and the hearing will be heard on JANUARY 22, 2019 at 10:00 a.m. in Judge O'Neill's courtroom. If necessary, Ms. Rabenn is allowed to appear by telephone.

The January 22 hearing will either be a change of plea hearing or a trial setting conference.

IT IS SO ORDERED.
