ORDER RE: (1) AERC DESMOND'S TOWER, LLC'S MOTION FOR RELIEF FROM THE AUTOMATIC STAY (ECF NO. 1371); AND (2) DEBTOR'S SECOND EMERGENCY MOTION FOR TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION (ECF NO. 143)

(RELATES TO BOTH MAIN CASE AND ADVERSARY PROCEEDING)

TO ALL PARTIES AND THEIR COUNSEL OF RECORD:

The Court, having considered (1) AERC Desmond's Tower, LLC's Emergency Motion For Relief From The Automatic Stay (ECF NO. 1371), and (2) Debtor's Second Emergency Motion For Temporary Restraining Order And Preliminary Injunction (ECF No. 156) (collectively, "Motions"), and good cause appearing therefore, HEREBY ORDERS that the Motions are GRANTED IN PART AND DENIED IN PART according to the terms of the tentative ruling attached hereto as Exhibit A and the mitigation measures agreed upon by the parties on the record at the November 6, 2015 hearing, which include the parties' agreement that AERC Desmond's Tower, LLC may commence alleyway demolition and construction as of Monday, November 9, 2015, regardless of the date on which this Order is entered.

IT IS SO ORDERED.
